Date: March 10, 2009 To: Foidel Creek Mine Annual Reclamation Report File From: Janet Binns Re: Review of 2008 Annual Reclamation Report for Twentymile Mine, C-82-056 CC: Dan Hernandez I have reviewed RAG-Twentymile Coal Company's 2008 Reclamation Report for the Foidel Creek Mine for compliance with Rule 2.04.13. 2.04.13(1) Report submittal date: January 28, 2009 Page 2.04-82 of the Permit commits to submittal of the ARR by March 15`" of the year following the reported calendar year. TCC submitted the 2008 ARR prior to the required date. (a) Name and Address of permitee: Foidel Creek Mine 29515 Routt County Road No. 27 Oak Creek, CO 80467 Permit Number: C-82-056 (b) Location and number of acres disturbed during 2008: 22.0 acres. No Reclamation Map was included. (c) Location and number of acres backfilled and graded during 2008: 0 acres. (d) Location and number acres topsoiled during 2008: 0 acres (e) The species, location and number of acres of vegetation planted during 20008, including any augmented seeding or cultural practices; 17 acres TCC reported that weed management practices were employed, but provided no detail regarding the location, species targeted for control, products used, or timing of application. TCC need to supply this information in order for DRMS to determine that TCC's weed management plan is implemented as approved in the permit. (PAP section 2.05.4(2)(e)(v) p. 2.05-114 through 2.05-114c) (f) Location, number of acres and date of planting for all previously revegetated areas. 41.2 acres (2) The permittee may provide additional monitoring information as required by the approved permit. No map was submitted as a part of the 2008 ARR. The 2008 ARR references Maps revised during PR7, and revisions approved during 2008.
