The Applicant intends to install all reservoir slurry walls at one time, prior to the start of mining in <br />Stages 2-5. Prior to the start of excavating slurry wall sealed mining stages the Applicant will seek <br />confirmation from the State Engineers Office (SEO) that each sealed stage meets the SEO's criteria <br />for water storage (see attached). <br />6.4.13 EXHIBIT M-Other Permits and Licenses <br />"Please submit proof of application for the stated permits, or that they have been acquired. " <br />Applicant's Response: <br />The list of other permits, licenses, and clearances for the proposed operations is as <br />follows: <br />• Air Pollution Emission Notice (Permit No. 08WE0521F) Colorado Department of <br />Health and Environment. Originally issued for Holton Lakes (DRM&S Permit # M- <br />2007-008), the applicant will amend the above permit to include the Morton Lakes <br />property. <br />• Groundwater Discharge Permit (Permit No. COG-501501) issued by the Colorado <br />Department of Health and Environment. Originally issued for Holton Lakes, the <br />Applicant will amend the above permit to include discharges from the Morton Lakes <br />operation. <br />• The Holton Lakes Storm-water Management Plan will be amended to include Morton <br />Lakes. <br />• Use by Special Review Permit Application (USR 1681) was submitted to Weld County <br />in November 2008. Currently USR 1681 is scheduled to be heard by the Weld County <br />Planning Commission on April 7, 2009. <br />• If needed, a Floodplain Use Permit (FUP) will be obtained from Weld County by the <br />Applicant. <br />• A Commercial Exempt Well Permit (No. 279050) for Morton Lakes has been issued by <br />the Colorado State Engineers Office (SEO). <br />• The Applicant will amend the Holton Lakes Temporary Substitute Water Supply Plan, <br />to include Morton Lakes. <br />3/3/2009 4
