Ill. COMMENTS - COMPLIANCE Colowyo C-1981-019 19 February 2009� Pg 114 Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments also describe any enforcement actions taken during the inspection and the facts or evidence supporting the enforcement action. This was a partial inspection of the Colowyo Mine conducted by Jim Stark of CDRMS. The inspection was conducted on 19 February 2009. Jennifer Sekulski of CCC accompanied me on the inspection. The mine was actively mining coal and hauling coal to the loadout at the time of the inspection. The weather was warm and sunny and there was snow on the ground at the time of the inspection. Roads: - The mine access road and haul road to the Gossard Loadout is a paved road. The road was dry and was well maintained and in good condition. - The light-use road in Taylor Draw to the West Pit Pond, East Taylor Pond and West Taylor Pond was covered with snow at the time of the inspection. The road was very slick but appeared to be stable and well maintained. The road was only open to the East Taylor Pond. The remaining road to the West Taylor Pond was inaccessible. - The haul roads in the East and West pit areas were all well maintained and stable at the time of the inspection. The roads were all dry at the time of the inspection. No erosional problems were noted on these roads. - The haul roads in the South Taylor Pit area were all dry at the time of the inspection. The roads were well maintained and appeared to be stable. No erosional problems were noted on the South Taylor haul roads. - The short road spur for access to the Prospect Pond was stable and in good condition at the time of the inspection. This road was upgraded and surfaced with gravel to assist in the cleaning of the Prospect Pond. Hydrologic Balance: - The Wash Bay Pond (not a NPDES discharge point) contained water approximately two feet below the top of the embankment and was not discharging. This is a total containment pond and discharge into the Work Area Pond triggers BTEX testing (in addition to regular NPDES testing). The pond embankment was covered with snow but appeared to be well vegetated and stable at the time of the inspection. No erosional problems were noted on the pond embankment at the time of the inspection. - The Work Area Pond (NPDES 002A) contained water approximately two feet below the top of the discharge pipe and was not discharging at the time of the inspection. The pond embankment was well vegetated and appeared to be stable at the time of the inspection. No erosional problems were noted on the embankment at the time of the inspection.
