We have read and analyzed your questions and have in our <br />response have tried to answer the questions to the best of our ability. We understand that <br />the decision date is February 14' 2009. We believe that this correspondence will <br />satisfactorily address your concerns and no extension of time will be needed. <br />The following items are a review of Rule 3, 6.1,6.2, 6.4 and 6.5 of the Minerals Rules and <br />Regulation of the Colorado Mined Land Reclamation Board for Construction Materials. <br />The items will be addressed in the order as presented in your letter dated January 6, 2009. <br />6.4.3 EXHIBIT C- PER-MINING and MINING PLAN MAP OF AFFECTED LANDS <br />1.) The Mining Plan does show the processing area, with the Topsoil Stockpiles and <br />Processing Equipment. However this is not the only area that topsoil will be <br />stockpiled. Topsoil will be stored in many areas that will facilitate the <br />replacement of the Topsoil with minimal transportation. The Mining Plan Map as <br />been revised to show the proposed locations of other Topsoil Stockpiles. The <br />applicants / operators intent is to move the topsoils only to the stockpile and then <br />back to the disturbed area for seedbed preparation. <br />2.) The permit area has two (2) nameless drainages. The drainage features where not <br />shown on the original submittal due my mistake. The drainway are now depicted <br />on the Mining Plan Map.
