<br />The Permit area contains approximately 13,180 acres of surface lands of which 5,551
<br />acres are on private land and 7,629 acres are on Federal land.
<br />The following descriptions identify and describe the documents upon which Oxbow
<br />Mining, LLC bases its legal right to enter and begin coal-mining operations. Information
<br />on ownership and right of entry is included in Exhibit 2.03-E1, Ownership and Right of
<br />Entry documentation. None of the existing rights are the subject of pending litigation.

<br />Deeds from Kaiser Coal Corporation to Somerset Mining Company dated December 1, 1989.
<br />Deeds from Somerset Mining Company to Pacific Basin Resources, a Division of Oxbow
<br />Carbon & Minerals, Inc., dated August 31, 1995.
<br />The conveyance documents transferring ownership from Oxbow Carbon & Minerals, Inc. to
<br />OMI were executed on December 23, 1997.
<br />Coal Lands
<br />Deeds from Kaiser Coal Corporation to Somerset Mining Company dated December 1, 1989.
<br />Deeds from Somerset Mining Company to Pacific Basin Resources, a Division of Oxbow
<br />Carbon & Minerals, Inc. dated August 31, 1995.
<br />The conveyance documents transferring ownership from Oxbow Carbon & Minerals, Inc. to
<br />OMI were executed on December 23, 1997.
<br />Federal Lands (Combined Surface and Minerall
<br />Federal Coal Lease No. COC-53510, dated effective November 1, 1992, for the Sanborn East
<br />Tract.
