III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a Complete Inspection of the Bowie No. 1 Mine conducted by Marcia Talvitie of the <br /> Colorado DRMS beginning at the mine office at 11:30 a.m. on 29-Jan-2009. No one was <br /> available to represent the operator, Bowie Resources LLC, during the inspection. <br /> The weather was mostly cloudy, and cold. The field portion of the inspection included the East <br /> Mine and West Mine (both viewed from a distance), the Well Field, he R.O.M. / Timber Storage <br /> area, the Paonia Loadout, and the Highway Coal Stockpile area. <br /> Current permitting activities for Bowie No. 1 are limited to TR-51, which provides reclamation <br /> details for the Cropland post-mining land use at the Paonia Loadout. <br /> Availability of Records <br /> • Records were available for viewing at the BRL office located at the Bowie No. 2 Mine. A <br /> completed "DRMS Availability of Records" form is attached. <br /> • The Coal Mine records at the Paonia Public Library were examined. Numerous envelopes <br /> regarding the Bowie mines had been received by the library; many were still unopened. <br /> Signs and Markers <br /> • Mine Identification Signs were posted, as required by Rule 4.02.2, at entrances to the West <br /> Mine (Figure 1), East Mine, and Loadout area. Topsoil markers were observed at the Paonia <br /> Loadout stockpile. <br /> Roads <br /> • The road to the West Mine was plowed as far as the saddle overlooking the permit area. A <br /> snowmobile was parked at the end of the plowed area, and tracks were evident in the snow <br /> on the road heading toward the mine. <br /> • Access to the East Mine was gated and locked. A motor grader was parked inside the gate, <br /> and it appeared that snow had been plowed from the haul road (Figure 2). <br /> • Cable gates were in place across the accesses to the R.O.M. / Timber Storage area and to <br /> Ponds 3 and 4. <br /> • All three Haul Roads accessing the Loadout were clear of snow and the gates were open. <br /> Within the Loadout, roads were partially melted and cleared of snow, although wet and/or <br /> frozen in spots. <br /> • The road to the highway coal stockpile area appeared to be soft; access was not <br /> attempted. <br /> Hydrologic Balance <br /> • Many portions of the Bowie No. 1 Mine were still blanketed by snow, including the Well Field, <br /> West Mine, R.O.M. /Timber Storage area, and upper portions of the East Mine (Figure 3). <br /> • Only three ponds were visible due to weather conditions: the Highway Coal Stockpile pond, <br /> which was frozen (Figure 4); and the Loadout and Timber Storage Area ponds, which were <br /> dry, although blanketed with snow. <br /> • The final phase of reclamation of the R.O.M. and Timber Storage Area consisted of removing <br /> the culvert pipe from the Stevens Gulch crossing and restoring the channel.
