SPECIAL PROVISIONS <br />Permit No. 5-7-77 <br />November 18, •1977 <br />Permission. granted to W. R. Grace Company and Partners to install an at grade <br />railroad crossing_on SH 40 approximately 1800' east of the East City Limits of the <br />Town of Hayden, subject to the following stipulations: <br />.The railroad.spur will be awned and maintained by permittee. If the crossing <br />becomes rough to. the traveling public at any time, permittee will repair as soon <br />as possible. <br />During. construction, at. least one-way traffic.=st be maintained at.all times <br />during working hours and mist be controlled by,adequate signs and flagpersons as <br />perscribed in the "Manual. on Uniform Traffic Control Devices", Then curing off <br />hours, traffic mist be returned to two-way over night and on weekends. Any <br />delay of traffic mist be held to a minimum. . <br />Excavation. under roadway must be 21" unless determined that,exisiting base <br />coarse; is of adequate quality.. Then the backfill to be placed in light lifts <br />and compacted to 95% AASHTO requirements using 12" of Class One, 6" of ...Class 6, <br />(or 18" of Grading C), with 3" of AC asphalt if the planking does not cover <br />the entire area,. Planking will be of a high quality preformed rubber, subject <br />to our"approval; Planking will extend across full width of roadway including.. <br />shoulders:... <br />The crossing will be protected. with standard railroad crossing flashing <br />lights and gates, installed before traffic starts.. on. the sputline: Where the.. <br />spur. enters the Highway right-of-way, protection will be installed so no live- <br />stock ,can..enter the highway. This will be accomplished by cattle guard or fencing <br />of spurline right-of way•;. <br />As.'agreed by Mr. E.K. 01•son in writing to Mr. R. A.-Prosence, if the average <br />frequency reaches.a level of a train a day, the pen-ittee will i= ediately initiate . <br />plaps to construct,a grade. separation at this location. The design and specification <br />of 'the facility will be according to the requirements of, the Division of Hightays,... ` <br />and would be,operational within a reasonable time.after it is determined by the <br />agreement. The cost of this. construction would be born totally: by W. R. Grace. <br />and Company and therewould be no cost to the Division of Highways, <br />copy of this permit must be on the job with contractor. <br /> <br />3-4.41
