MINE ID # OR PROSPECTING ID #: NA-9non-n1 A <br />INSPECTION DATE: 1-2n-9nn9 INSPECTOR=S INITIALS: ^11F <br />OBSERVATIONS <br />This was a partial acreage release inspection of the Riverbend Operation; DRMS file# M-2000-016. This site is <br />located approximately 1-2 miles southwest of Fort Lupton, Colorado in Weld County. I, Jared Ebert of the <br />Colorado Division of Reclamation Mining and Safety conducted the inspection. Anne Best Johnson and Sean <br />Frisch of Lafarge North America, Inc. (Lafarge) accompanied me on the inspection. <br />On December 23`d, 2009 the Division received an acreage reduction/ release request from Lafarge. According <br />to the last annual report for this site, mining has not been initiated yet. Lafarge is requesting the release of two <br />separate parcels of land. The first is a three acres parcel located northwest of the proposed Cell 2 in Phase 2 <br />south of Weld County Road 8. The second site is 32 acres in size and is located on the east half of the Phase 3 <br />site. This area encompasses part of the South Platte River, the mining setback, and a portion of the proposed <br />location of the topsoil overburden piles. For more specific information please see the map that was submitted <br />with the acreage release request. <br />This first site that was visited was the three acre site. Al. this location there is an access road that leads to an old <br />house, the remainder of the area appears to be an agriculture field. There does not appear to be any mining <br />related disturbance at this location. <br />Access to the 32 acre site is located due east of the first site on Weld County Road 8 on the north side of the <br />road just west of the South Platte River. An access road leads to a house located at this site, this road also <br />continues north further into the parcel. According to Mrs. Johnson, Lafarge has not disturbed this site. <br />However, they claim to have a lease agreement with Aurora Water, who is currently conduction work projects <br />at the site. According to Mrs. Johnson, these projects are part of the "Prairie Water Project". A long strip of <br />land appears to have been disturbed by motorized equipment constructing metal box structures of unknown <br />purpose (see Figures 5-8). However, it does not appear that the disturbance was caused by the mining <br />operation. However, to be sure; Lafarge will need to submit evidence, in the form of a copy of an agreement or <br />lease, that the observed disturbance is not in conjunction with the proposed mining operation at the Riverbend <br />Operation. Once the Division receives this evidence and it is deemed adequate, these two parcels of land are <br />eligible for release. <br />Also, it appears that a portion of the Riverbend Operation may encompass some if not all of the Fort Lupton Pit, <br />DRMS file# M-1985-088. If this is found to be the case, Lafarge should request of release of the Fort Lupton <br />Pit, however it is unknown if the entire Fort Lupton Pit is encompassed by the Riverbend Operation. This will <br />be addressed further in the Inspection Report for the Fort Lupton pit dated January 20th, 2009. <br />Also, on January 16th, 2009 the Division received a notice from the Division of Water Resources (DWR). The <br />notice included a list of the various ways the operator would consume ground water once mining at the site has <br />commenced. According to the notice, in order for mining to commence at the site the operator will need to <br />obtain the proper well permit and an approved water supply plan from the DWR. Also they stated that the <br />operator would need to document all wells within 600 feet of the permit area and obtain a waiver of objection <br />from all well owners with wells within that area. This notice will be enclosed with this report. <br />During the Amendment 01 application process, the operator submitted a ground water monitoring plan for this <br />2
