Testin ag rid Reporting Requirements <br />Tests shall be done at the frequency listed in Part I.B.I. Test results shall be reported along with the Discharge Monitoring <br />Report (DMR) submitted for the reporting period during which the sample was taken. (i.e., WET testing results for the first <br />calendar quarter ending March 31 shall be reported with the DMR due Aprll 28.) The results shall be submitted on the Acute <br />Toxicity Test repport form, available from the Division. Copies of these reports are to be submitted to both the Division and EPA <br />along with the DMR. <br />The permittee shall conduct an acute 48-hour WET test using Da hnia ma na and an acute 96-hour WET test using Pimephales <br />promelus (fathead minnow). The permittei: shall <br />conduct eat acute WET test in general accordance with methods described in Methods for Measurin the Acute Toxici of <br />Effluents and Receivin Waters to Freshwater and Marine Or anisms, EPA/600/4-90/027 or t e most current edition, except as <br />mods le y t e most current Division gut ante document entitled Guidelines for Conducting Whole Effluent Toxicity Tests. <br />b. Failure of Test and Division Notification <br />An acute WET test is failed whenever the LCsp, which represents an estimate of the effluent concentration which is lethal to SO% <br />of the test organisms in the time period prescribed by the test, is found to be less than or equal to l00% effluent. The permittee <br />must provide written notification of the failure of a WET test to the Division, along with a statement as to whether the <br />Preliminary Toxicity Incident ('PTI")/Toxicity Identification Evaluation ("TIE") investigation or accelerated testing is being <br />performed (see next section). ~iotification must be received by the Division within 14 calendar days of the demonstration of <br />acute WET in the routine required test. "Demonstration" for the purposes of subparts b., c., d. and f. means no later than the <br />last day of the laboratory test. <br />c. Automatic Compliance Schedule Upon Failure of Test <br />If a routine acute WET test is failed, the following automatic compliance schedule shall apply. As part of this the permittee shall <br />either: <br />i. proceed to conduct the PTUTIE investigation as described in subpart d., or <br />ii. conduct accelerated testing using the single species found to be more sensitive. <br />if accelerated testing is being performed, the permittee shall provide written notification of the results within 14 calendar days of <br />corn letion of the "Pattern of Toxrci "/"No Toxici "demonstration. Testin will be at least once every two weeks for up to <br />five tests until I) two consecutive tests fail or three o~five tests fail, in which case a pattern of toxicity has been demonstrated or, <br />2) two consecutive tests pass or three of five tests pass, in which case no pattern of toxicity has been found. If no pattern <br />toxicityty is found the toxicity episode is considered to be ended and routine testing is to resume. If a pattern of toxicity is foun ' <br />a PTl/TIE investigation is to be performed. If a pattern of toxicity is not demonstrated but a significant level of erratic toxicity is <br />found, the Division may require an increased frequency of routine monitoring or some other modified approach. <br />d. PTIII'IE <br />status re ort is to be rovided to the Division at the 30 60 and 90 da oints of the PTI/TlE invesii anon. "l he Division may <br />exten the time flame for investigation where reasonab a justification exists. A request or an extension must be made in writing <br />and received prior. to the 120 day deadline. Such request must include a justification and supporting data for such an extension. <br />The permittee may use the time for investigation to conduct a PTI or move directly into the TIE. A PTI consists of ii brief <br />search for possible sources of WET, which might reveal causes of such toxicity and appropriate corrective actions more simply <br />and cost effectively than a formal TIE. If the PTI allows resolution of the WET incident, the TIE need not necessarily be <br />conducted. If, however, WET is not identified or resolved during the PTI, the TIE must be conducted within the allowed 120 <br />day time frame. <br />Anyy permittee that is required to conduct a PTI/T1E investigation shall do so in conformance with procedures identified in the <br />following.documents, or as subsequently updated: I) Methods for A uatic Toxici Identification Evaluations Phase 1 Toxici <br />Characterization Procedures, EPA/600/6-91/003 Feb. 91 an 2) Methods for Aquatic Toxicity Identification Evaluations, Phase <br />[I Toxicity 1 entification Procedures, EPA/600/3-88/035 Feb. 1989. <br />A third document in this serieg is Methods for A uatic Toxicit .Identification Evaluations Phase III Toxici Confttrnation <br />Procedures, EPA/600/3-88/036'Feb. 1989. This investigation is optional. <br />Within 90 days of the determination of the toxicant oi- no later than 2l0 days after demonstration of toxicity, whiclie;ver is <br />sooner, a control program is to be developped and received by the Division. The program shall set down a method and procedure <br />for elimination o the toxicity to acceptable levels. . <br />e. Request For Relief <br />The permittee may request relief from further investigation and testing where the. toxicant has not been determined and the <br />Division .has determined sortable treatment does not appear possible. In requesting such relief, the permittee-shall submit <br />material sufficient to establish. the, following: , <br />~. <br />i.
