Effluent Limitations <br />PART I <br />Beginning no later than the effective date of this permit and lasting through the expiration date of the permit, the permittee is <br />authorized to discharge from Outfalls 001 and 004. <br />In accordance with the Water Quality Control Commission Regulations for Effluent Limitations, Section 62.4, and the Colorado <br />Discharge Permit System Regulations, Section 61.8(2); 5 C.C.R. 1002-61, the permitted discharge shall, not contain effluent <br />parameter concentrations, which exceed the following limitations specified below or exceed the specified flow limitation. <br />a. Alternate Limitation Burden of Proof Requirements <br />The ppermittee has the burden of proof when seeking relief from settleable solids (SS) limitations, as applicable: Discharges from <br />outfall 001 are not eligible for this relief. Discharges from Outfall 004 are eligible for relief from SS on the basis that only surface <br />runoff discharges are authorized from this outfall. <br />Relief may be granted for each discharge occurrence only when necessary and shall not be granted when the permittee has control . <br />over the discharge. The permittee should endeavor to meet the primary limitations whenever possible. <br />a. For rainfall to waive settleable solids limitations, it is necessary to prove that discharge occurred within 48 hours after <br />measurab~precipitation has stopped.. <br />b. For snowmelf to waive settleable solids limitations, it is necessary to prove that discharge occurred within 48 hours after pond <br />in ow as stopped. <br />Should. a precipitation event or sndwmelt occur, the permittee shall submit adequate proof in order for an exemption to be claimed. <br />Weather station data may be appropriate in making this demonstration. Said proof shall be submitted as an attachment to the <br />Discharge Monitoring Report (DMR) for the appropriate peri.gd.. The. Division shall determine the adequacy of proof. As part of this <br />determination, the Division shall evaluate whether the permittee:could have controlled the discharge m such a manner that.pnmary <br />limitations could have been met.. All manual dewatennQ of ponds that are equipped with automatic dewatering sys'temsmust meet . <br />settleable solids !imitations. if a pond has only manual c~ewatering capability, relief is available only to ttie extent required 'to regain . , <br />necessary stability and capacity. <br />Revised 10/29/2008 <br />
