The SWMP may reflect requirements for Spill Prevention <br />Control and Countermeasure (SPCC) plans under section 311 0( the C1VA, or Best Aanagement Practices <br />(BMPs) Programs otherwise required by a CDPS permit, and may incorpora[e any pan of such plans into the <br />SWMP by reference. The S1VMP may rely upon information developed for other similar pollution control <br />programs, including the Mined Land Reclamation Plan. Appropriate portions of these other plans may be <br />incorporated in the SWMP by reference, as long as a complete SWMP can be reproduced :md submitted to the <br />requesting agency within the time frame specified in the request. Those portions of the referenced documents <br />must be included in the submittal. The complete SWMP must also be readily available to an on-site inspector. <br />9) Allowable Nun-Stormwater Discharecs. The plan shall identify all sources of irrigation retum flow and natural <br />uncontaminated spring water that are combined wi[h Stormwater discharges associated with industrial activity. <br />The plan shall identify and enure the implementation of appropriate measures to prevent pollution of [he <br />non-Stormwater component(s) of the discharge. <br />Irrigation return flow and natural spring water which mix with mine drainage or process water became mine <br />drainage or process water. <br />(c) Stormwater Management Plan ltericw, Implementation, and Comnlinnce <br />1) SWMP Review/Changes: Should the Division choose to require Bcar Coal Company to submit a copy of the <br />SWMP for review, upon review of the S1VMP, the Division may notify the permittee at any time that the plan <br />does not mee[ one or more of the minimum requirements of this permit. After such notification, the permittee <br />• shall make changes to the plan and shall submit to the Division an update to the plan including the requested <br />changes. Unless otherwise provided by the Division, the permittee shall have 30 days alter such notification to <br />both make the necessary changes to the plan, to implement them, and to submit the changes to the Division. <br />The permittee shall amend the plan whenever there is a change in design, construction, operation, or <br />maintenance which has a significant effect on the potential for the discharge of pollutants to the waters of the <br />State, or if the S\VMP proves to be ineffective in achieving the general objectives of controlling pollutants in <br />Stormwater discharges associated with industrial activity. Amendments to the plan may be reviewed by the <br />Division in the same manner az described about. <br />2) SWMP Implementation and Cpmpliance: Bear Coal Company shall maintain full implementation of the Bear <br />Mine No. 3 SWMP and be in compliance with it during the life of this permit. The SWMP shall be updated az <br />appropriate. <br />A Stormwater Management Plan for the Bear Mine No. 3 was received by the Division on March 30, 1993. <br />(d) Prohibition of Non-stormvvatcr Discharecs <br />1) Except az provided in paragraph 2), below, all discharges authorized by this portion of this permit shall be <br />composed entirely of stormwa[er. Discharges of material other [hart Stormwater must be addressed by the <br />process water controls in this CDPS permit. <br />2) Discharges from the following sources that are combined with Stormwater discharges associated with industrial <br />activity may be authorized by this permit, provided that the non-Stormwater component of the discharge is <br />identified in the SWMP: fire fighting activities, foundation or footing drains where Bows are not contaminated, <br />springs, and landscaping irrigation retum Ilow. <br /> <br />1NnaP November lI, 19AI <br />
