• and the W1/2 of Section 16,T13S, R90W; with the proposed additional <br />permit sites to the southeast of the town of Somerset, and located <br />in their present permitted boundary. The mine operation exists <br />along a reach of the North Fork of the Gunnsion River at an <br />elevation of 6,000 feet. The topography typifies a mountain river <br />valley with steep side walls, and a significant river gradient. <br />The valley has a general east/west orientation. State Highway 133 <br />runs along the valley floor, and provides the corridor to the Town <br />of Paonia to the west, and McClure Pass to the east. <br />Surface owners of the coal to be mined include Atlantic <br />Richfield Company, and Larry and Elaine Mautz. A statement within <br />the LUC application notes that surface owners cannot stop the <br />mining of coal from under their property, but these owners have <br />specific rights which are identified in the Division of Minerals & <br />Geology (Rule 4.20.3., Surface Owner Protection). In general <br />terms, this Rule protects economic viability of surface owners by <br />requiring subsidence control and reimbursement if existing <br />structures are damaged. <br />PUBLIC HEARING: <br />A public hearing was conducted December 16, 1994 by the <br />Planning Commission. No public was present for this hearing and no <br />• written comments were received by the Planning Department. <br />COMPLZANCS WITS LAND II8E POLICIES: <br />GENERAL LAND USE POLICIES: <br />1.
