III. COMMENTS - COMPLIANCE <br /> Colowyo C-1981-019 <br /> 20 January 2009 <br /> Pg 114 1 <br /> Below are comments on the inspection. The comments include discussion of observations <br /> made during the inspection. Comments also describe any enforcement actions taken during <br /> the inspection and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection of the Colowyo Mine conducted by Jim Stark of CDRMS. <br /> The inspection was conducted on the morning of 20 January 2009. Ryan Pawlowski <br /> of CCC accompanied me on the inspection. The mine was actively mining coal and <br /> hauling coal to the loadout at the time of the inspection. The weather was very cold <br /> and clear and there were several inches of snow on the ground at the time of the <br /> inspection. <br /> Roads: - The mine access road and haul road to the Gossard Loadout is a paved <br /> road. The road was wet in places from melting snow but was well maintained and <br /> in good condition. <br /> - The light-use road in Taylor Draw to the West Pit Pond, East Taylor Pond and West <br /> Taylor Pond was covered with snow at the time of the inspection. The road <br /> appeared to be stable and well maintained. The road was only open to the East <br /> Taylor Pond. The remaining road to the West Taylor Pond was inaccessible. <br /> - The haul roads in the East and West pit areas were all well maintained and stable at <br /> the time of the inspection. The roads were all dry at the time of the inspection. No <br /> erosional problems were noted on these roads. <br /> - The haul roads in the South Taylor Pit area were all dry at the time of the inspection. <br /> The roads were well maintained and appeared to be stable. No erosional problems <br /> were noted on the South Taylor haul roads. <br /> - The light-use roads around the Gossard Loadout and to the rail loop were wet but <br /> appeared to be well maintained and in good condition. <br /> - Colowyo, through their contractor Anson, has made some upgrades to the small <br /> road spur to the Prospect Pond to facilitate the cleaning of the pond. This work <br /> included increasing the berm height, blading the surface and applying gravel/rock <br /> to aid in stability and reduce the amount of mud tracked onto Colorado Highway 13. <br /> Hydrologic Balance: - The Wash Bay Pond (not a NPDES discharge point) contained <br /> water approximately one foot below the top of the embankment and was not <br /> discharging. This is a total containment pond and discharge into the Work Area Pond <br /> triggers BTEX testing (in addition to regular NPDES testing). The pond embankment <br /> was covered with snow but appeared to be well vegetated and stable at the time of <br /> the inspection. No erosional problems were noted on the pond embankment at the <br /> time of the inspection. <br /> - The Work Area Pond (NPDES 002A) contained water approximately three feet below <br /> the top of the discharge pipe and was not discharging at the time of the inspection. <br /> The pond embankment was well vegetated and appeared to be stable at the time <br /> of the inspection. No erosional problems were noted on the embankment at the <br /> time of the inspection. <br />
