INTRODUCTION <br />• SCC will apply for release of the bond held by the Colorado Division of Reclamation, Mining and Safety. The first <br />step in obtaining bond release is to obtain a letter from the landowner consenting to the proposed postmine <br />reclamation and land use plan. The second step is to obtain a letter for the affected surface owner requesting that <br />identified features/structures (specifically roads) be left as permanent. These steps are in accordance with the <br />Colorado Mined Land Board Regulations for Coal Mining. <br />• Rule 2.05.5(11(bl, the postmining land use description shall be accompanied by a copy of the comments concerning the proposed use <br />by the legal or equitable owner of record of the surface of the proposed permit area and the State and local government agencies which <br />mould have to initiate, implement, approve, or authorize the proposed use of the land following reclamation. <br />Rule 4.03.1(11(fl. all haul roadr shall be removed and the land affected reclaimed in accordance with the requirements of 4.03.1(7) <br />unless: <br />(i) Retention of the road is approved as part of the approved postmining land use and the road complies with all applicable <br />performance standards; and <br />(ii) The landowner requests to the Division in writing, that the read or certain parts thereof are to be left open for further use. <br />The landowner letters are contained in this attachment within Appendix 20-1.1, Landowner Letters. <br />PERMANENT FEATURES/STRUCTURES <br />The features and structures to be left permanent include the following. <br />• Access roads <br />• • Light use roads <br />• Culverts <br />• Water well <br />• Power line and substation <br />• Fenced shrub plots <br />• Sediment ponds <br />• Stock ponds <br />• Miscellaneous boundary and grazing fences <br />Rationale, justification, and documentation are provided in the following discussions to demonstrate compliance <br />with the approved reclamation and land use plan. <br />Access Roads <br />Road "A". The postmine land use calls fora 20 foot wide limited access road to remain inplace using the <br />approximate original haul road centerline. This road is approximately 3.05 miles in length (16,100 feet). The edges <br />of the original road have been regraded, ripped, topsoiled and seeded to create the new average 20 foot wide limited <br />access road. Drainage control along this road consists of designed ditches and culverts. SEDCAD design <br />calculations are contained in Tab 13, Facilities. Exhibit 20-2, Post Mining Topography, shows the locations of these <br />roads. The road profiles and cross-sections are included in Tab 20 as Exhibit 20-3, Post Mine Road Profiles. <br />Road `B". This road has been retained in part at 20 feet in width and the remainder narrowed to a light use road <br />LU 3A. Drainage control along this road consists of designed ditches and culverts. SEDCAD design calculations <br />are contained in Tab 13, Facilities. <br />• Road `B" Extension. This original haul road has been retained in part as a 20 foot wide access road (approximately <br />1,800 feet), the remainder is retained as light-use roads LU 3A/3B. <br />TR-37 20-1.1 08/08 <br />
