• Construction Summary <br />In accordance with Ruie 4, Part 4.05.6(10) of the Rules and Regulations of the Colorado <br />Mined Land Reclamation Board pursuant to the Colorado Surface Coal Mining <br />Reclamation Act 34-33-101 et seq., I, Thomas E. Leidich, state that during construction <br />of Sedimentatton Pond 014 inspections were conducted by MWH personal under my <br />supervision. Seneca Coal Company constructed Pond 014 under the supervision of Mr. <br />Roy Kato, Reclamation Manager, and Mr. Dan Allen, Surveyor. Mt. Kato and Mr. Allen <br />ensured that all work w•as performed in accordance with the design and the specifications. <br />Mr. Matt Mathisen (MWH), under my supervision, inspected the structure on a regular <br />basis to verify compaction and to make sure that the embankment was being constructed <br />in accordance with Rule 4, Patt 4.05.6(10). My self and/or Jay James (MWH) were also <br />on the site at several critical occasions during the construction of this pond, as well. <br />MWIi summary of compaction testing for this project is located in Addendum ]3-17-D <br />The purpose of my inspection and certification was to make sure proper construction of <br />• Sedimentation Pond 014 and to satisfy the requirements of Rule 4.05.6(70) of the <br />Colorado Mined Land Reclamation Board. The material was placed in the embankment <br />to meet or exceed the design specifications (see Addendum 13-17-E for compaction <br />information). This as-built report confirms the construction of this structure meets or <br />exceeds the Rules and Regulations of the Colorado Mined Land Reclamation Board. The <br />structure is stable, evidencing no indications of slope instability. <br />To the best of my knowledge, based upon my professional expertise, and to the extent <br />possible, Pond 014 at the Yoast Mine was constructed in accordance with the prudent <br />state-of-the-art methods for earthen embankment construction. Further, the structure <br />was constructed in compliance with the approved design, to the extent possible, as <br />specified in Attachment ]3-]2, Drainage and Sediment Control Plan, of Seneca Coal <br />Company's approved mine permit. <br />r1 <br />LJ <br />13-17-3 <br />
