Overburden and topsoil, which are to be stockpiled during mining, are to be replaced separately during <br />reclamation. <br />The revegetation cost was calculated for a 19-acre mining phase plus 4 acres of roads and processing area, and it <br />now includes weed control. <br />The revised bond amount is significantly higher, since the original bond calculation accounted for a smaller <br />disturbed area: original phase 1 which was only 9 acres. The revised reclamation costs for this revision account <br />for a larger phase 1 (up to 19 acres) as well as the higher unit costs that have increased since 2003. This bond <br />amount is based on a requirement to concurrently reclaim disturbance as mining proceeds. <br />If any of the items above were interpreted in error please contact me promptly. <br />NOTICE OF BOND INCREASE <br />This letter also serves as a notice of bond increase. I have included the packet of revised reclamation costs <br />which reflect the new estimated for reclaiming the site during the phased mining operation. The new total bond <br />amount is $118,787, which is an increase of $70,787 above the $48,000 corporate surety bond currently held. <br />Pursuant to statute an operator must provide an bond increase within 60 days of the Division's notice. The 60- <br />day_period ends on March 10, 2009. You may provide an increase rider to the current bond, submit a separate <br />bond in the amount of the increase alone, or provide a replacement bond in the full amount. Which ever method <br />is chosen to provide the increased bond, the (combined) total must be sufficient. Any of the bond forms you <br />might need may be found on the Division's website (http //www.minin?, state.co.us) in pdf format. I encourage <br />you to begin promptly to arrange for submitting the bond increase, since there are often delays in preparing the <br />paperwork. <br />The bond documents and all questions about those documents should be directed to Ms. Elizabeth Taliaferro at <br />the Division's Denver office (see letterhead above). Her phone number is 303-866-3567 extension 8148. <br />The enclosed packet of revised reclamation costs includes a summary page listing all tasks, followed by detailed <br />pages of each individual task.
