The Applicant has estimated that <br />the exposed ground water surface area will be 0.23 acres during May through October, when <br />the site is dewatered; and 8.3 acres during November through March, when the dewatering <br />pumps are shut off-and the pond is allowed to fill. The estimated consumptive uses at the site <br />during this plan period are: <br />• 4.27 acre-feet for evaporative losses <br />• 1 acre-foot for dust control <br />• 1.62 acre-feet for water lost in product (55,000 tons per year estimated production) <br />• Total Consumptive Use = 6.88 acre-feet <br />Total Lagged Consumptive Use = 8.30 acre-feet <br />The SWSP accounts for depletions from current and past consumptive use at the Loloff <br />site. The lagged depletions were calculated using an SDF of 60 days. Attached Table 1 <br />specifies the lagged depletions from the evaporation and mining operations. <br />Replacement Sources <br />The replacement sources proposed for this operation include recharge associated with <br />one share of New Cache La Poudre Irrigation Company, the Loloff Section 4 Ditch and leased <br />water from the City of Greeley. <br />The applicant proposes to use the Loloff section 4 Ditch conditional water right for <br />replacement purposes, if available. The Loloff Section 4 Ditch collects seepage and waste <br />water in the vicinity of the Loloff Pit in the SW1/4 of the NW1/4 of Section 4, Township 5 North, <br />Range 65 West. The Division 1 Water Court adjudicated a conditional water right for the Loloff <br />Ditch in case no. 87CW152 for up to 4 cfs of water with an appropriation date of March 15, 1987 <br />(administration no. 50112.00000). The decreed uses of the Loloff Ditch include irrigation and <br />augmentation. According to the SWSP request, there is a flume and recorder to measure this <br />water right, which has been approved by the water commissioner. The applicant proposes to <br />use this water right first, if available, since it is a junior water right. <br />The applicant also owns 1 share of New Cache Irrigation Company and will utilize the <br />share under the Lower Poudre Augmentation Company ("LPAC") recharge program. The <br />recharge program is currently operating under a substitute water supply plan, pending approval <br />of associated water court cases 04CW025 and 06CW295. The New Cache La Poudre Irrigation <br />Company operates the augmentation plan and makes replacements. The amount of recharge <br />water available during this plan period is 3.25 acre-feet. <br />In addition, during the 2009, a lease of 4.53 acre-feet of fully consumable water provided <br />by the City of Greeley will make replacements during January through June 2009. The point of <br />replacement for the water provided by the City of Greeley will be the Greeley Wastewater <br />Treatment Plant which is located in the vicinity of Loloff Pit therefore no transit losses were <br />assessed. A copy of the lease agreement with the City of Greeley for 4.53 acre-feet of <br />consumable effluent from Greeley's wastewater plant was provided to this office with on <br />December 30, 2008 and is attached to this letter.
