r? <br />In order to lift the seasonal restriction for road and pad construction and to preclude potential disturbance to nestiEg <br />migratory birds: pre-construction breeding bird surveys will be conducted by a qualified biologist during the c3` <br />breeding period within the general disturbance area. Breeding bird surveys include identifying species present and, <br />checking for active nests. This includes keying in on areas where males are displaying when attempting to locate <br />active nests. Once clearance surveys are completed, if no active nests are found, and a survey report is submitted to <br />and approved by the BLM Biologist, activities may begin within the cleared areas. If active nests are found, access <br />road construction plans and/or drill hole locations will be modified, in consultation with BLM Biologist, so that nest <br />sites are not adversely affected. Development timing be constrained to preclude impacts during the breeding season <br />(May 15 - Aug 1). <br />If any raptor or breeding bird nests with eggs or young are encountered during construction activities during the <br />breeding season (May 15-Aug 1), operations will cease immediately and a BLM biologist will be notified to <br />determine appropriate mitigation measures. <br />B. With Respect to sensitive plants: <br />Site specific surveys for sensitive plants shall be conducted on site prior to development of any surface facilities or <br />other soil disturbance activities. <br />There shall be no surface occupancy or soil disturbing activities within 100 ft radius of sensitive plant locations. <br />C. With respect to bald or golden eagle nests which may be established on the license area during the life of the <br />project, the following shall apply: <br />No new permanent surface facilities or disturbances shall be located within a 1/4 mile radius buffer zone around each <br />bald or golden eagle nest site. <br />No above ground activities will be allowed within a 1/2 mile radius buffer zone around each active eagle nest site <br />from November 15 to July 30 for bald eagles, and around each active golden eagle nest site from February I to July <br />15. <br />Any proposed surface facilities, disturbances or activities (noted above) in, or adjacent to, these buffer zones will <br />require approval from the BLM on a site-specific basis, after consultation with the USFWS. <br />D. With respect to bald eagle winter roost sites or concentration areas which may become established on the license <br />area during the life of the project, the following special stipulation shall apply: <br />No above ground activities will be allowed within a 1 /4 mile radius of winter roosts between November 15 and <br />March 15; development may be permitted at other periods. If periodic visits are required within the buffer zone after <br />development, activity should be restricted to the hours of 10 a.m. and 2 p.m. from November 15 through March 15. <br />E. With respect to other raptors (except American Kestrel) which may occur or become established on the license <br />area during the life of the project, the following special stipulation shall apply: <br />Conduct surveys for nesting raptors on the license area tract prior to development of any surface facilities. No <br />surface activities will be allowed within 1/2 mile radius of active nest sites between the dates of February 1 and <br />August 15, unless authorized by BLM on a site specific basis. <br />F. Any additional roads or drill sites will require prior approval and inventories. <br />2. The crucial big game winter range areas within the project area will be closed to project activities from December <br />1 through April 30 annually.
