3. All stream channel modifications (e.g. access road crossings) will be reclaimed to the approximate condition <br />(hydrologic function, and physical stability), that occurred prior to development. <br />4. Mud pits, if needed, will not be constructed in fill. <br />5. Newly constructed access roads will be fully reclaimed at completion of drilling. <br />6. Reclamation and drilling will occur as proposed in the Southeast Elk Creek #2 Exploration License Application. <br />7. If subsurface cultural or paleontological resources are unearthed during operations, activity in the vicinity of the <br />cultural/paleontological resource will cease and a BLM representative notified immediately. Pursuant to 43 CFR <br />10.4 the holder of this authorization must notify the authorized officer, by telephone, with written confirmation, <br />immediately upon the discovery of human remains, funerary items, sacred objects, or objects of cultural patrimony. <br />Further, the operator must stop activities in the vicinity of the discovery and protect it for 30 days or until notified to <br />proceed by the Authorized Officer. <br />8. The operator is responsible for informing all persons associated with this project that they will be subject to <br />prosecution for knowingly disturbing Native American Indian shrines, historic and prehistoric archaeology sites, or <br />for collecting artifacts of any kind, including historic items and/or arrowheads and pottery fragments from Federal <br />lands. <br />9. The operator is required to comply with the Clean Water Act, National Pollution Discharge Elimination System, <br />Stormwater Management Plans, Colorado Department of Public Health and Environment (CDPHE) standards. <br />10. The operator shall comply with all applicable federal and state fire laws and regulations, and shall take all <br />reasonable measures to prevent and suppress fires in the area of operations. Fire restrictions/guidelines during <br />periods of high wildfire danger will be followed as required by the Authorized Officer. <br />11. Mitigation measures will include A post rehabilitation noxious weed inventory will be conducted by the <br />applicant, with immediate treatment of weeds found. The inventory will be supplied to the BLM for incorporation <br />into the Invasive Specie Data Base. The operator is required to control weeds in accordance with BLM, State and <br />County regulations. The operator and BLM staff will monitor for noxious weeds and contact the applicant regarding <br />treatment required. As a safeguard to avoid the inadvertent invasion of noxious weeds, vehicle(s) will be pressure <br />washed at an offsite location prior to entering the site. This is a preventive measure for reducing noxious weed <br />infestation at the drilling site. If equipment is moved directly from site to site while on this project, then pressure <br />washing between sites is not required. However, if equipment is removed from a site, used elsewhere, then brought <br />back to the project area, pressure washing is required before the equipment can be used in the project area. This <br />pertains to heavy equipment such as bulldozers, backhoes, etc. Pickup trucks and passenger vehicles if coming from <br />an area of known infestations will be required to go through a car was before entering construction zone. <br />12. The road shall be maintained reasonably smooth, and free of ruts, soft spots, chuckholes, rocks, slides and <br />washboards. A regular maintenance program shall include blading, ditching, sign replacement, surfacing, and culvert <br />maintenance. During wet weather conditions, no mud blading will be allowed. When road conditions are such that <br />vehicles create ruts deeper than 4", travel activities will be temporarily suspended. The operator is required to correct <br />maintenance deficiencies when documented and directed by the Authorized Officer. <br />13. Vehicle traffic is limited to the bladed/traveled road surface. No pullouts, off-road parking or staging areas will <br />be allowed unless specifically authorized by the Surface Owner. "Keep vehicles on the road surface" signs may be <br />installed by the operator to assist with compliance as needed. <br />COMPLIANCE/MONITORING: Normal routine compliance inspections will take place periodically throughout the <br />life of the license. The inspections will be designed to monitor environmental effects of the project and to ensure that <br />the operator complies with the license stipulations. Compliance actions are to ensure that the operations are <br />conducted in accordance with the associated stipulations.
