associated with this process, the Field Manager will assume responsibility for whatever recordation and stabilization of <br />the exposed materials may be required. Otherwise, in those situations where the Field Manager determines that <br />mitigation, data recovery and/or salvage excavations are necessary, the operator will bear the cost. The Field Manager <br />will provide technical and procedural guidelines for the conduct of mitigation. Upon verification from the Field <br />Manager that the required mitigation has been completed, the operator will then be allowed to resume construction. <br />(c) Notification - Contact the BLM at least 48 hours prior to commencing construction of access roads and drill sites. <br />(d) Deer and Ells Winter Range - see attached Finding Of No Significant Impact (FONSI). <br />(e) Nesting Birds - see attached FONSI. <br />(f) Raptor nests - see attached FONSI. <br />(g) Surface disturbance - The maximum disturbed width for road construction and reclamation shall not exceed 20', except <br />where slightly wider disturbance may be necessary for sharp comers, pullouts, and staging areas. The maximum surface <br />disturbance for drill pads shall not exceed 75' x 100'. Soil and vegetative disturbance shall be held to the minimum <br />necessary for conducting drilling operations. <br />(h) Tree removal - New drill sites and access roads shall be cleared of trees prior to any construction. Stumps shall be <br />scattered or buried. Any stump left in place shall be cut so that the stump height does not exceed 6 inches. The material <br />may be removed from the area or scattered near the site. If left on site, all slash shall be scattered such that the material <br />is within 24 inches of the ground at all points. A wood permit from BLM for 10 cords of pinyon/juniper shall be <br />required prior to any clearing. <br />(i) Soil stripping - Topsoil and vegetation (excluding trees) shall be stripped together to at least a depth of 6 to 8 inches <br />from drill-sites and segregated for spreading over the site during reclamation and seeding. No topsoil stripping will be <br />allowed when soils are moisture saturated to a depth of 3 inches, or frozen below the stripping depth. <br />0) Containment pits - All drill fluids shall be contained in a tank or dug pit. The cuttings pits shall be dry or with little <br />standing water prior to backfilling. <br />(k) Weed control - see attached FONSI. <br />(1) Hazardous wastes - Care should be taken to prevent spilling of fuel, hydraulic fluid, or oil, and any contaminated soil <br />should be treated or disposed of properly or re-mediated onsite. Fueling and maintenance activities shall not take place <br />in or adjacent to any drainages (perennial or ephemeral.). All product containers (oil and hydraulic fluid cans, etc.) shall <br />be removed from the site and disposed of properly. <br />(m) Hole plugging see Fonsi #12, and page 6 of this document. <br />(n) Monitoring wells - Separate approval is required for any proposal to convert any drill holes into water monitoring <br />wells. Any approved monitoring wells would require the well to be completed so as to isolate the aquifer(s) being <br />monitored as well as casing and cementing off other aquifers and minable coal beds encountered. <br />(o) Road maintenance - see attached FONSI. <br />(p) Culverts and drainage crossings- see EA. <br />(q) Blocking reclaimed roads - see EA. <br />(r) Reclamation - see EA.
