VII) EXHIBIT S PERMANANET MAN MADE STRUCTURES <br />The operator only listed a Union Pacific Rail Road as the only man made structures with in <br />200 feet and has agreed to stay 250 feet from center line of the rail road on each side. However, <br />during the pre-operational inspection there were several power poles noted with in the permit <br />and affected areas. Do there power lines belong to Front Range Aggregates ? If not, the operator <br />will need to commit to staying the required 200 feet or provide an engineering study in lieu of <br />an agreement with the owners of these structures that they will not be impacted by the <br />proposed activity. It is also the understanding of the Division that all man made structures <br />noted during the pre-operational inspection belong to Front Range Aggregates. <br />All other exhibits were found to be adequate. The Division has received timely objections which <br />were faxed to the operator. In order to allow the Division adequate time to review the requested <br />information, which we had not received to date, had asked the operator to waive their right to a <br />decision with in 90 days which they had agreed. To date we have not received the written <br />waiver. Until we receive the waiver, we can not change the education date and also set the dates <br />for the Pre-hearing an MLRD board dates. In order to expedite the process please send us a <br />written decision waiver.
