be below the invert channel of the Arkansas River ? If it is, how does the operator plan to <br />mitigate impacts to the river, please explain. <br />4) Is the operator planning to obtain two NPDES discharge permits one for the quarry <br />and another for the sand and gravel operation ? What is the pumping configuration for that <br />will be utilized. Please explain. <br />5) The Division has received comments from the State Engineers Office. The SEO has <br />confirmed that Front range Aggregates has a well permit for evaporative loss during <br />operation. Is the operator planning to construct a separate well water storage area for use on <br />site or is the water going to be pumped from the well ? Please also place the location of the <br />well on either the Mining plan or reclamation plan maps. <br />6) The Division has finally received on 11/7/07 the Tallahassee Creek flood plan study <br />supplied to FEMA. Has the study and its conclusions been accepted by FEMA ? In the <br />study, the operator's report concludes that much of the inundated area shown on the <br />current Flood Insurance Rate Map (FIRM) to be in fact outside of the 100- year Flood Plain <br />for the site. Did FEMA agree with your conclusions ? Please provide their approval letter. <br />The Division recommends the operator to place all solvents, fuels etc., outside of the 100year <br />fold plain area. <br />7) As requested earlier, please provide the details for the pit dewatering. The operator <br />must include all structures that will be utilized to pump the water from the pits to the <br />natural drainage. The operator must include pit inflow calculations to show that the <br />proposed method will be able to handle the rate of pumping to keep the pits dry, so it can <br />be mined. Since wet mining is not being proposed, the operator has to also commit that no <br />kind of wet mining will be taking place. <br />8) Based on the proposed mining plan for the granite quarry the three drainages to the <br />Tallahassee creek will be impacted. Has the operator obtained a permit from the Army <br />Corps to allow them to impact these drainages ? Three settling ponds are planned in <br />association with these drainages. Please provide details of these ponds. Are any of these <br />ponds going to remain in place after mining or going to be part of the reservoir ? Please <br />explain. <br />9) The operator states " Later Phase of the quarry development will result in closed basin <br />that captures all drainages from the tree basins. Due to the steep slopes above the mine, it <br />will be difficult to reroute these drainages around the mining limits with out excessive <br />disturbances of the hill side. It is proposed that any storm water entering the mine site be <br />pumped and returned to the river for the life of the mining operation'. What is the expected <br />Pak flow from these drainages to the pit? What kind of pumping system is the operator <br />proposing given the depth final depth of the quarry? The details of the design has to include <br />the of pumps that will be required to pump the water from the pit and the way it is going to <br />be conveyed to the river. The Division assumes the operator's reference to the river to be the <br />Tallahassee Creek. Please explain. <br />VI) EXHIBIT L RECLAM ATION COST ESTIMATE. <br />Once the Division receives the requested information above the cost estimation will be <br />calculated and provided to the operator for their review. <br />6
