M-2001-107 - NCCI Pit #1, 112 (c) Amendment Application Adequacy Review 01 Response, 1113012007 <br />-5- <br />2) The Division is unable to locate on Exhibit C- Mining Plan Map the "0.5 acre sediment pond" referred to <br />on page 41 of this section of the application. Is that the pond on the map labeled as "Temporary <br />Dewatering Pond?" <br />No, the sediment pond was inadvertently omitted from the Mining Plan Map. Please see the <br />attached revised Exhibit C map which shows the location of the sediment pond at the <br />northeast corner of Phase 1. <br />3) In accordance with Rule 6.4.7(2)(b), please identify on Exhibit C- Map all know aquifers. <br />Please see the attached revised Exhibit C map which lists the additional information. The <br />South Platte River alluvial aquifer and the Laramie-Fox Hills aquifer are the known aquifers <br />present at the site. <br />Rule 6.4.19 Exhibit S - Permanent Man-made Structures <br />1) In accordance with rule 6.4.19(a) for permanent man-made structures, please provide copies of the final <br />executed and notarized agreements pertaining to the oil and gas infrastructure at the site. <br />Final executed, notarized, and recorded surface use agreements with the pertinent oil/gas <br />companies will be forwarded to the Division when they are obtained. NCCI believes that the <br />final agreements will be obtained within 1 to 2 months. Until the final agreements are <br />obtained, NCCI will maintain a minimum setback of 200 feet from any oil/gas facility during the <br />mining activities as discussed on page 6 in the amendment application. <br />Letters of Obiection/Concern <br />1) The State Engineer's Office has advised Applicant that the current substitute water supply plan (SWSP) is <br />valid through December 31, 2007, and that the SWSP renewal must cover all depletions that will result <br />from the expanded operation. A copy of this correspondence is attached with this letter. <br />A renewal application for NCCI's approved SWSP which accounts for all depletions resulting <br />from the expanded operation has been submitted to the SEO for review and approval. <br />2) The Colorado Division of Wildlife provided a letter of comment with several recommendations on <br />mitigating the impacts to wildlife in the area of operation. A copy of the letter is attached. <br />NCCI believes that the recommendations for mitigating the impact to wildlife contained in this <br />letter have been adequately addressed through the investigations (wetland delineation, <br />threatened and endangered species screening) that have been done for the site and through <br />the planned methods of operation and reclamation for the site. <br />3) DRMS received a letter from Mr. William Gee, an adjacent landowner, dated Nov. 1, 2007, clarifying that <br />he does not wish to be an official objector to the Amendment Application.
