2) The Division is unable to locate on Exhibit C- Mining Plan Map the "0.5 acre sediment pond" referred to
on page 41 of this section of the application. Is that the pond on the map labeled as "Temporary
Dewatering Pond?"
No, the sediment pond was inadvertently omitted from the Mining Plan Map. Please see the
attached revised Exhibit C map which shows the location of the sediment pond at the
northeast corner of Phase 1.
3) In accordance with Rule 6.4.7(2)(b), please identify on Exhibit C- Map all know aquifers.
Please see the attached revised Exhibit C map which lists the additional information. The
South Platte River alluvial aquifer and the Laramie-Fox Hills aquifer are the known aquifers
present at the site.
Rule 6.4.19 Exhibit S - Permanent Man-made Structures
1) In accordance with rule 6.4.19(a) for permanent man-made structures, please provide copies of the final
executed and notarized agreements pertaining to the oil and gas infrastructure at the site.
Final executed, notarized, and recorded surface use agreements with the pertinent oil/gas
companies will be forwarded to the Division when they are obtained. NCCI believes that the
final agreements will be obtained within 1 to 2 months. Until the final agreements are
obtained, NCCI will maintain a minimum setback of 200 feet from any oil/gas facility during the
mining activities as discussed on page 6 in the amendment application.
Letters of Obiection/Concern
1) The State Engineer's Office has advised Applicant that the current substitute water supply plan (SWSP) is
valid through December 31, 2007, and that the SWSP renewal must cover all depletions that will result
from the expanded operation. A copy of this correspondence is attached with this letter.
A renewal application for NCCI's approved SWSP which accounts for all depletions resulting
from the expanded operation has been submitted to the SEO for review and approval.
2) The Colorado Division of Wildlife provided a letter of comment with several recommendations on
mitigating the impacts to wildlife in the area of operation. A copy of the letter is attached.
NCCI believes that the recommendations for mitigating the impact to wildlife contained in this
letter have been adequately addressed through the investigations (wetland delineation,
threatened and endangered species screening) that have been done for the site and through
the planned methods of operation and reclamation for the site.
3) DRMS received a letter from Mr. William Gee, an adjacent landowner, dated Nov. 1, 2007, clarifying that
he does not wish to be an official objector to the Amendment Application. A copy of the letter is attached.
No additional action on the part of the Applicant is required.
