Russell Means <br />101 South 3`a Street, Suite 301 <br />Grand Junction, CO 81501 <br />Re: Camilletti Pit, M-1987-164, AM-O1; Preliminary Adequacy Review Response <br />Dear Mr. Means: <br />The following discussion and attachments are submitted on behalf of our client, Connell <br />Resources, Inc., in response to the Preliminary Adequacy Review comments prepared by the <br />Division of Reclamation, Mining, and Safety (DRMS) dated November 24, 2008 for the <br />Camilletti Pit Amendment Application (AM-01). The information and discussion below address <br />each comment which requested clarification or correction; division comments are presented in <br />italics. <br />1. Per Rule 1.62(e) the Division requires proof of notices to all adjacent landowners <br />identified in the amendment application. DRMS, has not received proof of notice to the <br />adjacent landowners. <br />Certified mail receipts for all of the neighboring land owners within 200 feet of <br />the boundary of the affected land are included as an attachment to this letter. A <br />copy of the letter sent to each landowner is also included. <br />2. Please find enclosed comments from the Corp of Army Engineers. Please address any <br />concerns within their letter and provide documentation that the Corp has no issues to the <br />Division. <br />Nathan Green, Regulatory Project Manager at the United States Army Corps of. <br />Engineers, Colorado West Regulatory Branch stated in an email to Jared Dains <br />dated December 17, 2008, "[a]fter reviewing the photos, I have determined that . <br />there does not appear to be any wetlands or waters of the United States in the <br />areas that the photos were taken." This information should address any <br />inconsistencies associated with the comments in the above referenced letter from <br />the United States Army Corps of Engineers dated November 13, 2008.
