According to your letter dated December 4, <br />2008 iwe needed to provide you with additional information regarding changes that will be made <br />to the final reclamation of the site and how the area will be mined. This additional information is <br />provided below. However, before getting into that explanation, I first wanted to explain an <br />adjustment to Technical Revision 01 that we need to make. According to our original Technical <br />Revision application documents dated November 26, 2008, we indicated that we would be <br />removing land located in the west half of the southeast quarter of Section 1, TIN, R67W and in <br />the northeast quarter of northwest quarter of Section 12, TIN, R67W from the permit boundary. <br />However, this will not be the case so please disregard this request. We have followed up per <br />your direction with an Acreage Reduction/Release Request which clarifies what areas of the <br />permit we do want to exclude from the permit boundary. <br />To address your request for additional information regarding changes in the Mining and <br />Reclamation Plans for the property, the Mining and Reclamation Plan maps included in our <br />November 26, 2008 Technical Revision application are accurate in showing how the property is <br />now proposed to be mined and reclaimed. These maps do not include any information for the <br />mining and reclamation of Phase 9, Cell l; therefore, all information shown on the currently <br />approved Mining and Reclamation Plan maps still apply to this cell. As I indicated in my <br />November 26, 2008 cover letter, the Mining and Reclamation Plans for the rest of the cells were <br />adjusted in response to Surface Use Agreements worked out with the Oil and Gas Companies <br />regarding future drilling sites. Following is an explanation of the changes shown on the revised <br />mining and reclamation maps submitted November 26`h: <br />1. line total area to be mined decreased from 672.5 acres to 633 acres.
