Cattany <br />Division Director <br />Natural Resource Trustee <br />The DRMS received a letter from the Division of Water Resources (DWR) on December 18th in <br />response to your November 18, 2008 letter to DWR regarding groundwater discharge from the <br />proposed Red Cliff Mine. Enclosed please find one copy of the recent letter from Dr. Mark <br />Vanarelli of the DWR. The DWR indicates that CAM-Colorado LLCs' proposal to pump <br />groundwater from the Red Cliff Mine would require either a dewatering permit from the State <br />Engineers Office or a demonstration that the groundwater is non-tributary as defined in CRS 37- <br />90-103(10.5). Otherwise the SEO has no objections to the proposed permit application. <br />The DRMS hereby incorporates the DWR's review comments regarding the need for a <br />dewatering permit or groundwater demonstration as described above into our preliminary <br />adequacy review for the Red Cliff Mine new permit application. At the time that CAM provides <br />responses to the DRMS preliminary adequacy review, please include a written response and <br />supporting documentation regarding the dewatering permit/groundwater demonstration as <br />required by the DWR. <br />Thank you for your cooperation.
