III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> acres at Loma Loadout. The portal access road has been successfully reclaimed. The graded backfill <br /> slopes in the portal area blend in well and conform to the original topography and there have been no <br /> signs of slope instability with this inspection or during previous inspections of the area. All other areas <br /> requested for bond release have been restored to the approximate original contour of the pre-mining <br /> landscape. Slopes generally are in agreement with approved post-mining contours as shown on the <br /> Reclaimed Configuration Maps (Figures 3.1-5 through 3.1-7). The final certification for the waste <br /> disposal site was completed and submitted to the DRMS in April 2008. The waste pile and reclaimed <br /> topsoil pile are properly reclaimed and stable with no problems noted. <br /> Drainages were reconstructed as post-mine features at all of the ephemeral tributaries crossing the <br /> portal access area. Surface runoff control appears adequate. Reconstructed drainages throughout the <br /> reclamation remain in good condition with maintenance needed on limited areas noted previously in <br /> this report. A small area at the base of Post-mine Channel E will require additional riprap and liner <br /> repair. There is minor slumping at the former ventilation portal which will require additional <br /> backfilling, roughening and reseeding. Numerous silt fences require replacement or repair including <br /> along the perimeter of Post-mine Channel H, three silt fences along the edge of the former mine bench <br /> near the portals, and one at the reclaimed topsoil pile. The Loma Loadout was in good condition <br /> except for the silt fence that needs to be replaced. <br /> There are no areas identified as erosionally unstable that would be excluded from this Phase I bond <br /> release request. The 1.3 acres associated with the former haul road on BLM land will be eligible for <br /> Phase I bond release once the culverts as shown on Figure 2.2-7C, Lower Road Reclamation are <br /> removed and low-water crossings/dry fords are properly installed. The silt fence repair and <br /> backfill/stabilization of the ventilation portal are maintenance items that will not preclude release from <br /> Phase I bond liability. To ensure compliance, the maintenance items identified in this inspection report <br /> should be completed as soon as practicable(weather permitting). <br />
