III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> slope in the vicinity of the portals is shown in Photo No. 18 and a portion of the backfilled and graded <br /> portal access road is shown in Photograph No. 19. <br /> There are some minor settling cracks in the immediate vicinity of the portal backfill. As seen in <br /> attached Photo No. 20 there is a significant settlement crack along the base of where three portals were <br /> backfilled. This is expected to heal with time and will continue to be monitored. A bigger concern is a <br /> small area of sloughing(Photograph No. 21) in the location of what appears to be the site of the former <br /> ventilation portal. This will require some remedial work to ensure that the portal remains properly <br /> sealed and stable. Since there is no vehicle access to this location it is recommended that the area of <br /> slumping be hand-worked with a shovel by tamping down and roughening to the extent possible. The <br /> area should then be reseeded. To ensure compliance please repair the slump at the ventilation portal <br /> site as soon as practicable. <br /> Processing Waste <br /> The waste disposal site was included in this Phase I bond release request. The final coal mine waste <br /> bank inspection of the Munger Canyon Mine waste disposal site was conducted in April 2008 in <br /> accordance with Rule 4.10.2(2)(a). The pile has been covered with 3.5 feet of non-toxic cover, 6- <br /> inches of topsoil, extensively roughened, seeded, and mulched. The final certification dated 4-16-08 <br /> was provided to DRMS by James E. Stover, P.E. The waste disposal site(Photograph No. 22) was <br /> inspected and no appreciable erosion or other problems were identified. <br /> Loma Loadout <br /> The Loma Loadout site (Photograph No. 23) is located approximately %2 mile east of Loma on <br /> Highway 6. Access to the site is from the first turnoff going south from Highway 6. The site is 2.9 <br /> acres and is long and narrow. There is a mine identification sign,berm and silt fence for runoff and <br /> sediment control. As seen in the attached Photograph No. 24, the silt fence is torn and needs to be <br /> replaced. The berm appears to be functional but has a significant amount of coaly material in it. When <br /> the berm is removed in the future, some of the coaly material may need to be transported to a waste <br /> disposal site possibly to McClane Canyon Mine. This determination will be made at a future time <br /> when the berm is reclaimed. The silt fence needs to be repaired as soon as practicable to ensure <br /> compliance. Site drainage and surface water runoff control appear to be adequate. No problems were <br /> noted at the Loma Loadout site that would preclude Phase I bond release. <br /> Reclamation Success <br /> The areas requested for Phase I bond release have been reclaimed in accordance with the approved <br /> reclamation plan, except for the 1.3 acres of haul road and adjacent lands described above under <br /> "Roads" on page 2 of this report. The 1.3 acres as described and shown on the Phase I Bond Release <br /> Map submitted with this application will be excluded from the bond release request. A total of 17.2 <br /> acres are proposed for Phase I bond release including 14.3 acres at the Munger Canyon site and 2.9 <br />
