Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation Mining and Safety has begun the review process for the <br />above referenced 112c amendment application. Per Rule the tentative decision date is set <br />for December 23, 2008. The date may change if all issues have not been addressed by <br />that time. Staff has completed a Preliminary Adequacy Review (PAR). Please note, <br />clarify or correct the following: <br />Per Rule 1.6.2(e) the Division requires proof of notice to all adjacent landowners <br />identified in the amendment application. DRMS has not received proof of notice to the <br />adjacent landowners. <br />Please find enclosed comments from the Corp of Army Engineers. Please address any <br />concerns within their letter and provide documentation that the Corp has no issues to the <br />Division. <br />Per Rule 6.2.1(2)(b) all maps must be signed by a registered land surveyor, professional <br />engineer, or other qualified person, give date prepared and identify and outline the area <br />which corresponds with the application. Staff notes no signatures on any maps. Also <br />present maps do not clearly show the permit boundaries. They show lease and parcel <br />boundaries. Some areas currently disturbed appear to be outside of parcel boundaries and <br />the permit. The fuel tanks and reclamation currently identifiable on the maps appear to <br />be outside boundaries.
