III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> The operator continues to do the initial work on gob pile no. 3,which lies between old state highway 133 and <br /> the railroad tracks,just east of the downhill conveyor. The collection ditches,culverts and silt fence were up at <br /> the site.The operator has salvaged more topsoil than originally planned for so a second topsoil stockpile has <br /> been started to the west of the initial topsoil stockpile.The location of the coverfill stockpile has been moved to <br /> the west of its original planned location,as well.Erosion control blankets have been placed on the first topsoil <br /> stockpile,but the second stockpile is still active.Topsoil signs were up on both topsoil stockpiles. <br /> Hubbard Creek Vent Shaft Area <br /> There was no activity at the Hubbard Creek vent shaft construction site.The shaft has been completed and the <br /> underground mine workings will join up with the shaft in a few weeks.There was an excavator on site to <br /> reclaim the mud pit,which has been drying out.The operator will install facilities for the shaft site,including an <br /> escape hoist.No fan will be installed. <br /> The upland diversion ditch protecting the entire site had sufficient capacity.The pad berm was up and silt fence <br /> protected the adjacent Hubbard Creek. Surface disturbance markers and stream buffer zone signs were up.Mine <br /> ID signs need to be put up at each of the two entrances rather than along the Hubbard Creek road.The operator <br /> will also put up straw bales across the south entrance to the site for extra sediment control. <br /> About 100 feet up the main road from this site was the recently completed D-seam dewatering hole.The <br /> operator had approval to drill the hole into the D-seam workings and is in the process of obtaining approval to <br /> install a pipe from the dewatering hole to the vent shaft,which is completed in the B-seam workings. Water will <br /> be pumped from the D-seam up to the surface and piped to the B-seam workings via the vent shaft. The drill pad <br /> was protected with silt fence.The topsoil stockpile was surrounded by silt fence but needs a topsoil stockpile <br /> sign. The mud pit was protected by plastic fence. <br /> Unit Train Loadout <br /> There was an unloaded unit train sitting at the loadout during the inspection.No problems with fugitive dust <br /> were observed at the loadout. There was no water in either pond J or pond K.The loadout bench outslope was <br /> well vegetated along the entire length of the bench. The collection ditch leading into pond K was well vegetated. <br /> The culverts and ditches leading into pond J were clear.The mine id sign was up at the entrance and surface <br /> disturbance markers were up around the disturbed area. <br /> Records <br /> All of the required mine records were at the mine office,as documented on the attached records checklist. <br /> c:/word/bowie2/insp 1108 <br />
