M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DRMS.Bill Bear represented the <br /> operator during the field inspection and during the records check. <br /> Main Mine Site <br /> The utility bench was stable,with the drainage ditch in the rear and the bench outside edge berm in place.The <br /> rock catchment berm above the bench was in place as well.The topsoil stockpile was well vegetated and had a <br /> topsoil sign in place.To the west of the bench was the small seep that has a dark orange color.The road up to <br /> the utility bench was in good shape with the inside road ditch and the outside berm in place. <br /> There was only a small volume of coal stockpiled on the D-seam portal bench.The operator was dismantling the <br /> D-seam portal conveyor structure since it is no longer needed.The culverts and ditches in the area were <br /> functional.The material storage areas on the bench and to the east of the bench were well organized.The cap <br /> and powder houses were double locked.There were no leaks at the fuel barn.The contractor is continuing to <br /> work on the haul road realignment project on the last curve before the D-seam portal bench.The excavated <br /> curve has soil nailed walls in two places.The french drain has been installed as well.The contractor was also <br /> working on lessening the slope angle of the cut slope that is above the B-seam portal bench and below the haul <br /> road realignment section. Other cut and fill slopes around the mine site appeared to be stable. <br /> The ditches and culverts on the B-seam portal bench and adjacent to the excess material storage area were in <br /> place. The excess material storage area appeared to be stable.The main topsoil stockpile was well vegetated and <br /> had topsoil stockpile signs in place.The ditches and culverts along the entire length of the main haul road were <br /> functional.The wildlife overpass over the downhill conveyor was in place. <br /> There was only a small volume of stockpiled coal at the main coal stockpile bench that is adjacent to old state <br /> highway 133.4 he coal stockpile bench berm was in place.The culverts and ditches around the wash plant and <br /> substation were functional,although the inlet of the culvert next to the gob loading bin had a rock close to the <br /> inlet and should be moved.The culverts and ditches that lead into pond B had sufficient capacity. There was <br /> very little water in pond B.The pond spillways were operational,with the float attached to the primary <br /> discharge hose.Riprap and straw bales were in place. The mine id sign was up at the mine site entrance. The <br /> straw bales were in place at the pump house. The mine id sign was up,as were the surface disturbance markers. <br /> Coal Waste Stockpiles <br /> The gob pile haul road was in good condition.The road had been recently watered to prevent dust,as the gob <br /> pile was active.The road outside berm and ditches were in place.The material storage areas along the road <br /> corridor were well organized.Pond C had a fair amount of water in it but was not discharging.The float was on <br /> the primary discharge hose. The emergency spillway had the designed capacity.There was only a little standing <br /> water in pond D.The culverts and ditches leading to pond D were operational.Topsoil stockpiles in this area <br /> were well vegetated and had the proper signage. Straw bales were in place as well at the topsoil stockpiles. <br /> There was activity on the east end of the gob pile area.Gob was being trucked to the site and a dozer was <br /> spreading the gob out for compaction.The gob was moist but not wet.Near the west side of the gob pile,a <br /> grader with a sheep's foot compactor was operating.The pile had positive drainage and the upland diversion <br /> ditch had sufficient capacity. Surface disturbance markers were up around the disturbed areas. <br /> 1 <br />
