III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Reclamation, Mining, and Safety (Division). This mine site is currently completing the final <br />stages of reclamation of disturbed areas. Ground conditions were dry and the weather was <br />cold, overcast, and breezy. <br />Availability of Records <br />The public copy of the mine records is kept at the office of Peak Project Management (PPM). <br />The contact, address, and phone number for PPM is Ron Thompson, Peak Project <br />Management, 34115 County Road 20.8, Trinidad, CO 81082, 719-846-4975. Records were <br />found in compliance as detailed on page 2a of this report. <br />Hydrologic Balance <br />Pond 8 is now dry and is likely to be cleaned of sediment while equipment is at the site as <br />weather and ground conditions allow. Pond 9 has a blockage in the culvert passing through <br />the embankment in about twenty feet from the primary spillway riser. The operator will dig <br />out this section of the embankment and repair the damaged portion culvert. Water levels are <br />well below the lowest hole on the riser. Ponds 7a and 9a held small amounts of water as did <br />pond 6. The sediment marker has disappeared from pond 6 and should be replaced as soon <br />as possible. Pond 5 held water. No ponds were discharging and embankments all appeared <br />in normal condition. <br />A culvert is likely necessary to divert disturbed area drainage from west of fill 8 across the <br />road to the gas well northwest of fill 8. Road grading by the gas operator has changed the <br />drainage pattern in this location. Repair of the culvert above pond 9 is also required due to <br />heavy flows and steep grades in <br />this area. <br />Excess Spoil <br />The operator was actively <br />working on the west downdrain at <br />fill 7. Rock was being excavated <br />from near pond 6 from a <br />sandstone outcrop where it was <br />then trucked and dumped above <br />the west downdrain before <br />placement in the downdrain (see <br />right). <br />Since the last inspection, the <br />operator has completed work at <br /> <br /> <br /> 36, <br />J M l 1 5''1 y? - _ <br /> <br /> <br />
