RECEIVED <br />NOV 0 72008 <br />Recap of incident at 15 road fueling CR 9 & 10 on November 5, 200&NDJUNCTIuNFiccDOFFICE <br />DIVISION OF <br />RECLAMATION MINING & SAFETY <br />• At approximately 1:35 pm a skid-steer backed into a fueling truck <br />• The operator of the skid-steer was working and the driver of a third party fueling truck did not <br />make eye contact with the skid-steer operator to let him know he was pulling in behind <br />• The skid-steer backed up and the back roll bar punctured the sidewall of the fuel truck <br />• Immediately workers put a berm around the truck and spill area <br />• The remaining fuel was pumped from the breached container to another container <br />• Fuel spilling out was contained in a garbage can until level in truck went below breached area <br />• Once fuel was drained out of the truck it was backed out of the area <br />• United had dump trucks on site hauling material from this pit to another location <br />• We immediately grabbed the first truck that was already on location and used the loader to <br />excavate the contaminated area <br />• It was estimated the spill area was approximately 10'x12'x3-4" deep <br />• The total excavated area was approximately 20'x22'x18" deep <br />• The ground under the excavated area was inspected and the ground was dry and there was no <br />smell of diesel <br />• It is important to note there was no contamination of any ground water or other water source <br />• The area of the spill is very hard ground and in fact the fuel was still pooled on the top when <br />excavation happened <br />• Contaminated soil was immediately loaded in the truck and hauled to United's Railhead location <br />and piled on top of recycled asphalt pile <br />• The contaminated soil was placed at the top of the pile and within the sidewalls of the berm <br />• When I inspected the disposal area at approximately 3 pm the dirt was dry and moist with no <br />signs of any moisture running away <br />• 1 was on site of spill at approximately 2:30 and not only was the soil excavated but it was hauled <br />to the recycled asphalt pit for disposal <br />• It was estimated that the whole incident from time of accident to trucks loaded was no more <br />than 15 minutes
