Design Criteria <br /> <br />Topic Design Criteria-for the Proposed Action <br />Surface Water 54. Lease stipulations limit occupancy in riparian areas, Federal Coal <br /> wetlands and floodplains. Surface use in wetlands, Lease <br /> floodplains or riparian areas will be avoided unless Stipulation <br /> specially authorized. <br /> 55. Streams will not be paralleled byroads other than that Federal Coal <br /> needed for crossings. Lease <br /> Stipulation <br /> 56. Wetland areas would be avoided wherever possible and WCPH (FSH <br /> BMPs would be implemented for all activities to occur 2509.25), <br /> adjacent to or within these aquatic features. Federal Coal <br /> Lease <br /> Stipulation <br />Water Quality 57. Material from slides or other sources on roads will not be WCPH (FSH <br /> deposited in streams or other locations where it will wash 2509.25), <br /> into streams. Federal Coal <br /> Lease <br /> Stipulation <br /> 58. Disturbances to the prevailing hydrologic balance of the <br /> affected land and of the surrounding area and to the <br /> quantity or quality of water in surface and groundwater <br /> systems both during and after the mining operation and <br /> during reclamation shall be minimized by measures, <br /> including, but not limited to: State Law <br /> compliance with applicable Colorado water laws and <br /> regulations governing injury to existing water rights; <br /> compliance with applicable federal and Colorado water State and <br /> quality laws and regulations, including statewide water Federal Law <br /> quality standards and site-specific classifications and (33 U.S.C.A <br /> standards adopted by the Water Quality Control _ §§ 1251 to <br /> Commission; 1387) <br /> compliance with applicable federal and Colorado dredge State and <br /> and fill requirements; and Federal Law <br /> removing temporary or large siltation structures from <br />MCC Project <br /> drainways after disturbed areas are revegetated and <br /> stabilized, if required by the Reclamation Plan. Plan, BMP <br />Drilling Water 59. Drilling water (< 10 acre-feet per year for shaft and US Fish and <br /> MDW) will be obtained from MCC's non-tributary water Wildlife <br /> in the mine or Minnesota Creek. This quantity of water is Service <br /> within the GMUG's blanket consultation with USFWS (USFWS), <br /> for depletion associated with the Upper Colorado River Forest Plan <br /> System.
