6.4.15 EXHIBIT O - Owner(s) of Record of Affected Land (Surface Area) and <br />Owners of Substance to be Mined <br />This section is adequate as submitted. <br />6.4.16 EXHIBIT P - Municipalities Within Two Miles <br />This section is adequate as submitted. <br />6.4.17 EXHIBIT Q - Proof of Mailing of Notices to County Commissioners and Soil <br />Conservation District <br />This section is adequate as submitted. <br />6.4.18 EXHIBIT R - Proof of Filing with County Clerk and Recorder <br />This section is adequate as submitted. <br />6.4.19 EXHIBIT S - Permanent Man-Made Structures <br />There are several structures on and within 200 feet of the proposed amendment area (for <br />example: wells, power lines, underground utilities, underpass construction for roadways, <br />private residences, etc.). In accordance with Rule 6.4.19, when mining operations will <br />adversely affect the stability of any significant, valuable and permanent man-made <br />structure located within 200 feet of the affected area, the applicant may either: <br />a.) Provide a notarized agreement between the applicant and the person(s) <br />having an interest in the structure, that the applicant is to provide <br />compensation for any damage to the structure; or <br />b.) Where such an agreement cannot be reached, the applicant shall <br />provide an appropriate engineering evaluation that demonstrates that such <br />structure shall not be damaged by activities occurring at the mining <br />operation. <br />It is noted that you have provided a geotechnical stability analysis with the <br />application. However, Aggregate Industries is required to show proof of an <br />attempt to obtain agreements with all structure owners within 200 feet of <br />operations within the amended properties. Please provide evidence (certified <br />letter to structure owners) that a notarized agreement between the structure <br />owners and the applicant was pursued. If for some reason an agreement is unable <br />to be reached, the Division will review the Geotechnical Stability Exhibit as an <br />alternative for each of those structures.
