Climax Mine TR-12: Affected Land <br /> Exchange; Permit M-77-493. <br /> Dear Mr. Sorenson: <br /> Climax Molybdenum Company, Climax Mine is preparing a Technical Revision/Affected Land <br /> Exchange(TR-12)to rectify the inadvertant exclusion of 7.75 acres of reclaimed borrow area from <br /> the total affected lands and the addition 2.0 acres to affected lands to accommodate the Storke <br /> return water pipeline relocation Climax is proposing in TR-12 to add this 9.75 acres to the <br /> affected lands in exchange for 9.95 acres of undisturbed acreage that will be removed from the <br /> affected lands. According to Division policy dated March 28, 2000 regarding such affected land <br /> exchanges, a standard request for release of reclamation liability for the exchange lands must be <br /> approved prior to approval of the TR. Attached is the request from Climax per Rule 4.16.1. As <br /> per Rule 7.2.10,public notification for this aspect of the affected land exchange is required to be <br /> published one time. Proof of publication per Rule 7.2.10 will be forthcoming. Proof of <br /> notification of county commissions in Eagle, Lake and Summit Counties per Rule 4.16.1 (2) is <br /> attached. Climax is sole owner of the exchange land at issue. With this letter, Climax is <br /> requesting release from reclamation liability for the 9.95 acres described herein. <br /> The parcel for exchange is owned by Climax and is located on the attached maps and figure. The <br /> parcel is a block of open spruce-fir that has been undisturbed since the late 1800s. This parcel <br /> has been in and out of the affected land area at Climax. It was last added back into the affected <br /> land area in AM-003.
