Ground water is still exposed at the mine site (See Figure 2-5). The operator has two options; they can <br />cover the exposed ground water with a minimum of two feet of material above the highest ground water <br />elevations. Or the operator shall submit a substitute water supply plan and begin the process of <br />obtaining endorsement from the office of State Engineer (OSE) for this exposure. The oriinal due date <br />for this corrective action was July 30`I', 2008. "Then the date was extended to November 3r`' 2008 at the <br />request of the operator. A follow up phone conversation occurred with Mrs. Sue Pipken; she stated that <br />the problem could be corrected by December. The office will need a letter from Mrs. Pipken requesting <br />an extension of the corrective action date for this problem. <br />At this time the disturbed area appears to be about 11.30 acres out of the entire 110 acre permit. According to <br />Mrs. Pipken, some of the land within the permit boundary has been sold. Two homes have been constructed <br />within the eastern part of the permit boundary. The operator may want to consider requesting an acreage <br />release for a large portion of the site that has not been mined.
