MINE ID # OR PROSPECTING ID #: - M-19AA-n9n <br />INSPECTION DATE: 11-7-2008 INSPECTOR=S INITIALS: 11 F <br />OBSERVATIONS <br />This was a monitoring inspection of the Deer Trail Pit, DRMS file number M-1988-090. This site is located <br />approximately 1 mile southwest of the town of Deer Trail, Colorado in Arapahoe County. I, Jared Ebert of the <br />Colorado Division of Reclamation, Mining and Safety conducted the inspection. No one from the operation <br />was present during the inspection. <br />On April 24t", 2008 and inspection was conducted by Deb Zack and myself at this same site. During that <br />inspection there were five problems noted. This inspection was conducted to monitor the progress of correcting <br />the problems noted during the April inspection report. There were five corrective actions noted during the April <br />inspection, they are subsequently listed below with their current status explained. <br />1.) Mine entrance sign and permit boundary marker were not clearly posted per Rule 3.1.12 (2) and Rule <br />3.1.12 (2) (1) (c) which requires the operator to clearly label the mine entrance and the permit boundary. <br />The mine entrance sign was posted at the time of the inspection (see Figure 1). Upon entering the site, <br />an attempt was made to locate any remaining permit boundary markers. Four boundary markers were <br />observed in their approximate location. However, the two markers that delineate the eastern boundary <br />line were not in place. There was a fence that runs along where the eastern boundary line should be <br />located, but it is unclear where the north east corner marker should be located. The boundaries still <br />need to be clearly delineated <br />2.) Improper storage and containment of fuels and/or other hazardous materials was found on site. <br />Upon inspection of the site, it seemed that all the storage containers have been removed from the site, <br />none were found at the time of the inspection. This issue appears to have been resolved. <br />3.) The range of debris on the mine site such as concrete, tires, rusted metal, and old appliances <br />stockpiled on the mine site must be removed per C.R.S. 34-32.5-116 (4) (e) which states that "all refuse <br />shall be disposed of in a manner that controls unsightliness or the deleterious affects of such refuse." <br />Upon inspection of the site, it seems that the refuse have been removed from the site. This issue appears <br />to have been resolved. <br />4.) Russian olive was observed in several small sections in the pit. <br />Based on the boundary markers that were found on the site it does not appear that the Russian Olive <br />trees that were noted during the April Inspection are contained in the permit boundary. This no longer <br />appears to be an issue at this time. <br />5.) Ground water appears to have been exposed on the site without prior approval by the Office of the <br />State Engineer and submittal of an approved substitute water supply plan. No mention of groundwater <br />exposure was made in the approved reclamation plan. <br />2
