Page 2 <br /> June 16, 1989 <br /> Question: How will the amendment affect our mining <br /> property adjacent to Climax holdings? <br /> Answer: The permit amendment will have no affect or <br /> impact on your adjacent holdings . <br /> Question: What does 'surface rights to the immediately <br /> adjacent lands"mean? <br /> Answer: The term "immediately adjacent lands" originates <br /> from the Colorado Mined Land Reclamation Act and Mineral <br /> Rules and Regulations of the Colorado Mined Land Reclama- <br /> tion Board. The term is defined as " . . .those properties <br /> touching the affected land , the surface rights of which <br /> are owned by persons other than the operator." <br /> Question: How will our property be affected by Forest <br /> Service exchange lands and when rangeland and water <br /> resources are developed? <br /> Answer: The permit amendment does not involve exchange <br /> lands of any type. US Forest Service exchanges (or any <br /> exchanges) are not an issue in this amendment . Even if <br /> exchanges were an issue , there would be no impact on your <br /> property. Relative to "rangeland" and "water resource <br /> development" , the Colorado Mined Land Reclamation Act <br /> requires that the proponent of a mining operation or the <br /> mine operator in concert with the land owner select a <br /> final land use( s) goal toward which reclamation can be <br /> directed. As the sole owner of the Climax property, we <br /> have selected rangeland and water resources (as well as <br /> "Recreation" and "Industrial" ) as the ultimate land uses <br /> for the site ; rangeland because the area and region pres- <br /> ently is used extensively for summer livestock grazing , <br /> and water resource development because Climax owns signi- <br /> ficant and valuable water rights at the headwaters of <br /> three drainages . <br /> Again , thank you for your letter .
