III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety (Division) on 22 October 2008. The weather was cloudy and a small <br /> amount of sleet/snow mix during the on-the-ground inspection of the site. Graham Roberts of TMI <br /> accompanied the inspection. The ground was dry/damp at the time of the inspection. <br /> Areas identified as locations that needed to be repaired based on a Phase III bond release inspection <br /> conducted on 10/13/08 through 10/16/08, were also inspected for SL-10. <br /> Availability of Records <br /> See attached DRMS Availability of Records. All records were inspected at the Trapper Mine site. <br /> Signs and Markers <br /> Mine ID and Blasting signs were displayed in the locations required. All required information was <br /> properly displayed at the time of the inspection. Topsoil markers and Permit Boundary markers are <br /> delineated with a piece of PVC pipe attached to a T-post with either a P for permit boundary or T for <br /> topsoil. Topsoil markers and permit boundary markers were in good condition and displayed in the <br /> appropriate locations. All signs and markers were in compliance with Rules 4.02.2, 4.02.6(3) and <br /> 4.02.7 at the time of the inspection. <br /> Roads <br /> The access roads and light use roads were stable at the time of the inspection. Haul roads were <br /> stable and in compliance with no signs of damage during the inspection. The haul roads displayed <br /> adequate diversion ditches to ensure proper run-off. No excess dust was noted on the haul roads at <br /> the time of the inspection. <br /> All access roads were stable with no problems noted at the time of the inspection. <br /> Hydrologic Balance <br /> Ponds were being monitored by Graham Roberts of TMI during this inspection. Three ponds were <br /> discharging during the inspection. <br /> • No Name appeared stable with no problems noted. No Name contained water and had a <br /> discharge rate of .010 and pH of 8.2 and conductivity at 2460. <br /> • Middle Flume contained water and was discharging through the 1" Baskin flume at .41 and pH <br /> at 8.6 with 2010 conductivity. <br /> • Johnson contained water with discharge at .08 and ph at 8.5 and 3460 conductivity. <br /> The following ponds contained water with no flow at the time of the inspection: Ute, West Pyeatt#1, <br /> East Pyeatt, Grouse#2, Oak#1, West Flume, Deal, and West Horse. The following ponds were dry <br /> during the inspection: Deer, West Pyeatt#2, Middle Pyeatt, Grouse#2, Sage ponds, Oak#2, Horse <br /> #1, East Flume, and East Middle Flume. All pond embankments were stable and in compliance with <br /> no problems noted at the time of the inspection. No problems were noted with spillways and all <br /> spillways were in compliance at the time of the inspection. <br />
