IV. ENFORCEMENT ACTIONS

The following identifies enforcement actions taken during this inspection, the required
abatement and date of abatement for the violation, previous violations still requiring
abatement and the termination of violations cited during previous inspections.
Notice of Violation CV-2008-003 has been terminated.
Notice of Violation CV-2008-004 remains outstanding. A penalty for the violation has
been set and the Division and Colowyo have an assessment conference scheduled
for 7 November 2008.
Colowyo has almost completed the work on the Prospect drainage that was part of
the abatement for CV-2008-004. There was an excavator working on the north gully
at the time of the inspection. The south gully has been filled and several contour
ditches were installed to help control runoff. Colowyo has contracted with Anson
Construction to clean the Prospect Pond. The cleaning will commence as soon as
Anson can get a long-reach excavator mobilized to the site (on or around 17
November 2008).
