III. COMMENTS- COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> Hubbard Creek Vent Shaft Area <br /> The construction and lining of the vent shaft has been completed. The next steps are to reclaim the mud pit and, <br /> then,construct the facilities. The mud pit has not completely dried out yet. The upland diversion ditch, berm and <br /> silt fence were in place for sediment control. Mine id signs, surface disturbance markers and stream buffer zone <br /> signs were up. <br /> A little further up the valley,Bowie is drilling a dewatering hole to pump water out of the D-seam and into the <br /> B-seam. Once the water is in the B-seam workings, Bowie has proposed to discharge the mine water out of the <br /> B-seam portals and into the North Fork of the Gunnison River. The drill site and topsoil stockpile were <br /> protected by silt fence. A containment fence surrounded the small mud pit. Further up the valley from that site, <br /> Bowie has completed two slanted gob vent boreholes on one drill pad. The topsoil stockpile and pad were <br /> protected by silt fence and the small mud pit was protected by a fence. <br /> Unit Train Loadout <br /> A fully loaded unit train was on site. There was no indication of any fugitive coal dust at the loadout. The <br /> loadout and spur line bench appeared to be stable. Bench outslopes were well vegetated and no problems with <br /> erosion were observed. <br /> Pond J and pond K were dry. Pond embankments were stable. The collection ditches and half-culvert <br /> downdrains leading to the two sediment ponds were clear. <br /> The mine identification sign was up at the entrance off of highway 133.
