III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DBMS.Bill Bear represented the <br /> operator during the inspection. Longwall mining is currently in the B-7 panel. <br /> Main Mine <br /> The rock catchment berm above the main mine utility bench was in place. The adjacent topsoil stockpile had a <br /> good vegetative cover and the topsoil sign was up. There was no indication of the seep that had been observed <br /> previously on the west side of the utilities bench. The ditch at the back of the bench was in place. The access <br /> road to the utility bench was in good condition. Surface disturbance markers were up. <br /> There was only a small amount of coal that was stockpiled on the D-seam portal bench.The bench's outside <br /> edge berm was in place.The highwall was stable and the ditches on the bench had sufficient capacity. There <br /> were no fuel leaks at the fuel barn. The operator has started work on the upper curve of the paved haul road.The <br /> road in that section was slumping toward the B-seam portal bench below. The curve will be moved away from <br /> the present road outslope. The rest of the paved haul road was in good condition.Disturbance markers were up. <br /> The sediment ditches were in place on the B-seam portal bench. The bench berm was in place. The operator was <br /> cleaning up coal fines that had fallen on the outslope from the overhead conveyor that leads to the B-seam portal <br /> bench. The excess material storage area across the haul road from the B-seam portal bench appeared to be <br /> stable. The soil from the excavation at the haul road curve project was temporarily being stored there. The main <br /> topsoil stockpile below the B-seam portal bench was well vegetated. The topsoil signs were up. <br /> There was only a small volume of stockpiled coal on the coal stockpile bench adjacent to the highway.No <br /> indication of offsite fugitive dust or coal dust being tracked onto the highway was observed. Sediment control <br /> collection ditches that bring runoff to pond B were in place and had sufficient capacity. Straw bales for <br /> additional sediment control also were in place. There was very little water in pond B. The float was on the end <br /> of the primary discharge pipe hose.The pond had been recently cleaned. The pond B embankment was stable. <br /> Coal Waste(Gob) Stockpile Area <br /> The gob pile haul road was in good condition. The road ditch and road outside berm, as well as silt fence,were <br /> in place.The material storage area along the haul road was well organized. Gob pile topsoil stockpiles were <br /> protected with straw bales and had the proper topsoil stockpile signs. Surface disturbance markers were up. <br /> There was a small amount of standing water in pond C.The float was on the primary discharge pipe hose.There <br /> was no blockage or debris in the pond's emergency spillway.Pond C had been recently cleaned. Pond D was <br /> dry. The pond D discharge structures were operational. There was a little standing water in pond F. The float <br /> was on the primary discharge pipe hose. The pump for the primary discharge pipe was in place. Pond F had also <br /> been cleaned recently. <br /> There was no activity at gob piles nos. 1, 2 and 4,which are all connected together laterally. The upper <br /> diversion ditches had sufficient capacity and there was positive drainage on the gob piles. The outslopes of the <br /> gob piles appeared to be stable. There were no signs of slope instability or erosional gullies. There were no <br /> small piles of coal waste waiting to dry. The entire surface had been graded. <br /> 1 <br />
