Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation, Mining and Safety has completed its second adequacy review of your 112 <br />construction materials reclamation permit conversion application. The decision date for this application is <br />December 12th 2008. Thank you for responding to the first adequacy review. There are several items that still <br />must be clarified. Please remember that there is a Formal Board Hearing on December 10th or 11th, 2008 in <br />regards to this application. <br />The review consisted of comparing the application content with specific requirements of Rule 3, 6.1, 6.2, 6.4 <br />and 6.5 of the Minerals Rules and Regulations of the Colorado Mined Land Reclamation Board for the <br />Extraction of Construction Materials. Any inadequacies are identified under the respective exhibit heading <br />along with suggested actions to correct them. <br />6.4 SPECIFIC EXHIBIT REQUIREMENTS - REGULAR 112 OPERATIONS <br />The following items must be addressed by the applicant in order to satisfy the requirements of C.R.S. 34-32.5- <br />101 et M. and the Mineral Rules and Regulations of the Mined Land Reclamation Board: <br />6.4.4 EXHIBIT D - MininLy Plan <br />1. Please state which grass seed mixture will be used to stabilize the topsoil stockpile. Also, please commit to <br />seeding the topsoil stockpile if its life is greater than 180 days. <br />2. Please describe the "Stormwater Containment Dike". What are the dimensions of this berm, what material <br />will be used to construct this structure? Will this structure remain on the site after reclamation?
