STATE OF COLORADO
(VISION OF RECLAMATION, MINING AND SAFETY
Department of Natural Resources fe-
1313 Sherman St., Room 215
Denver, Colorado 80203
Phone: (303) 866-3567
FAX: (303) 832-8106
`'November 3rd, 2008
COLORADO
D I V I S I O N OF
RECLAMATION
MINING
SAFETY
Bill Ritter, Jr.
Governor
Harris D. Sherman
Executive Director
Ronald W. Cattany
Division Director
Natural Resource Trustee
R- k Spady
owa County
P.O. Box 100
Eads, Colorado 81036 ,
RE: Gray Pit, DRMS File Number M-19 0-148. Corrective Action from August/27 th,
2008 Inspection Report.
Mr. Spady,
On October 24th, 2008, the Division received your letter dated October 15th, 2008 addressing the
corrective actions outline in the August 27th, 2008 Inspection Report. Two problems were
identified in that inspection report. The first was in regards to the boundary markers that are to be
placed around the pit. Upon review of the photographic evidence, this problem is considered to
be resolved.
The second problem was in regards to the current approved mining and reclamation plan. The
current approved plans did not appear to correlate with the current operation. So, the Division
asked Kiowa County to submit a Technical Revision to the current approved mining and
reclamation plan. The intent of this Technical Revision was to update how the mining operation
is actually being conducted, and how the site is going to be reclaimed once mining has ceased on
the site. First off, a fee of $216.00 is required for the Technical Revision. Second, the revision
that was submitted in your October 15th, 2008 letter is not an adequate response to the corrective
action listed in the inspection report. The due date for the second corrective action listed on the
Inspection Report has been extended until December 1St, 2008. Please submit the Technical
Revision and the required fee to the Division on or before this date.
The corrective action for this problem called for four different items to be submitted:
1.) An updated Mining Plan
2.) An updated Reclamation Plan
3.) A new Mine Plan Map
4.) A new Reclamation Plan Map
When you submit the fee for the Technical Revision, please submit the following information:
1.) The Mine Plan needs to be a detailed narrative about how the sand and gravel is currently
being extracted and how extraction will continue into the future. At this time, there is a
Office of Office of
Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
