No new roads will be built, sample locations will be accessed overland using rubber-tired equipment, and access
will be limited to periods when the ground is dry or frozen in order to minimize surface disturbance. In order to
minimize surface disturbance, soil removal will be limited to the immediate area of each auger-hole or test pit, with
soil material being windrowed to the side of the disturbance area, and re-spread immediately following completion
of drilling/excavation/sampling and backfilling. Site runoff from the limited disturbance areas will be addressed
through the use of alternative sediment controls consisting of straw wattles, placed ands staked immediately
downgradient of each disturbance area. Auger drilling is a dry drilling operation, so no mud pits will be required,
and no discharge of drilling fluids will occur. Because the auger-holes and test pits will be in reclaimed mine spoils
on a hillslope, the potential for intercepting any significant quantities of ground water is negligible. Air will not be
used a circulation medium, so dust generation is not a concern.
Immediately following completion of sampling, each auger-hole and test pit will be backfilled with excavated
material and leveled, with seeding of all sample sites following, either prior to snowfall, or in early spring when
ground conditions permit. It should be noted that all minor surface disturbance associated with the site
geotechnical investigations falls within both previously disturbed areas, and the footprint of the proposed Refuse
Pile Expansion, and will be re-disturbed by Refuse Pile Expansion foundation preparation activities.
Concerning the Fish Creek Tipple, no excess spoil or underground development waste will be generated in connection
with the operation. Thus, the requirements of this section and Rule 4.09 are not applicable.
(9) Return of Coal Mine Waste to Abandoned Workinss
(a) Each plan shall describe the desi n operation and maintenance of any proposed coal
processing mine waste disposal facility including flow diagrams and any other necessary drawings and maps which
must meet the standards of 2.10 for the approval of both the Division and the Mine Safety and Health Administration
m accordance with 4.11.3.
(b) Each plan shall describe the source and quality of waste to be stored area to be backfilled
percent of the mme void to be filled method of constructin underground retaining walls influence of the backfilling
operation on actwe underground mme operations surface area to be supported by the backfill, and the anticipated
occurrence of surface effects following backfilling_
(c) The applicant shall describe the source of hydraulic transport medium method of dewateri~
the placed backfill, reeamment of water underground treatment of water if released to surface streams and the effect on
the hydrolo ig c regime.
(d) The plan shall describe each permanent monitoring well to be located in the backfilled
area, the stratum underlying the mined coal and gradient from the backfilled area
(e) The requirements of 2 OS 3 shall also apply to pneumatic backfilling operations except
where the operations are exempted by the Div~s~on from requirements specifying hydrologic monitoring
RESPONSE
TCC returns the thickener underflow generated at both Washplants I and [I to the abandoned and sealed
underground mine workings. When Washplant I initially began operations, the thickener underflow was partially
dewatered using afilter-press, and this material was then combined with the coarse refuse and hauled to the Refuse
Pile for placement. Due to handling and placement problems, TCC modified the fine refuse handling method, and
began pumping the thickener underflow into the abandoned mine workings in the Eastern Mining District (EMD),
as opposed to mixing it with the coarse refuse for placement on the Refuse Pile.
MR07-226 2.05-97.2 ~~~~,~ .~~a~ ~ ~ :~1~, ` 11/26/07
f ~~~
