III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> natural contour. The site of the reclaimed road was stable with no signs of erosion. The reclaimed <br /> light use road site is shown in Photograph Numbers 2 and 3. Cheat grass has become well established <br /> in this location. <br /> Hydrologic Balance <br /> There were no impoundments included in the bond release request area. The permanent rip rapped <br /> diversion ditch that originates above the South Portal and terminates at Pond 9 and the North <br /> Collection Ditch which receives the outflow from South Portal 18"CMP "A"were not included in the <br /> bond release request and therefore were not inspected as part of this bond release inspection. <br /> Five ditch segments included in the bond release area were inspected. These ditches are shown in plan <br /> view on Exhibit 6C. A typical cross-section for each of the five segments is provided in the PAP on <br /> Exhibit 26. See Exhibit 26 for pertinent design information including side slope gradient,channel <br /> bottom width, freeboard, and riprap size if required. One ditch is associated with the Access Road <br /> #1A, and is identified as Section E2-E2' at a grade of 2-10%. This ditch is well constructed with 9 <br /> inch riprap. The ditch was stable and functional. The remainder of the ditches E-E',El-El', <br /> and R-R' are not rip rapped. E-E' and El-E1'are located on the west side of the fruit storage,sales, <br /> and parking areas. Ditch El-El' is located along the west edge of the pavement and is contained by an <br /> earthen berm. Runoff is conveyed underground near the guard building and daylights at Ditch Section <br /> E-E' which then flows to Pond 8. During spring runoff or following a significant storm event water is <br /> ponded west of the guard building due to the very flat grade of Ditch El-El' at this location(see <br /> attached Photograph No.4). According to Brant Harrison owner/operator of Kokopelli Farm and <br /> Produce,the standing water does not present a significant problem. Ditch Il-Il' is located on the upper <br /> bench south of the repair shop and storage and receives the outflow from the French drains installed at <br /> the reclaimed South Portal highwall. The relatively short ditch segment is stable and no problems <br /> noted. Ditch R-R' is located atop the Roadside Refuse Disposal Area and conveys water across what is <br /> now identified as the Equipment and Material Storage Area for Kokopelli Produce. As seen in <br /> attached Photograph No. 5, some minor erosion was noted along this ditch segment which will require <br /> occasional maintenance. All of the ditch segments inspected as part of this bond release request were <br /> well constructed with no significant instability problems identified. <br /> Backfill &Grading& Support Facilities <br /> Permit Revision No. 3 (PR-3)was approved in July 2007 to change the postmining land use of <br /> portions of the South Portal facilities area to an alternative, Commercial postmining land use.
