III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection and a Phase I bond release inspection of a portion of the Roadside <br /> Portals Mine conducted on October 7, 2008 by Mike Boulay and Sandra Brown of the Division <br /> of Reclamation, Mining and Safety(DRMS). Mr. Brant Harrison landowner and Ms. Tonya <br /> Hammond of Snowcap Coal Company(SCC) were present during the entire inspection. Mr. Jim <br /> Stover of J.E. Stover& Associates, Inc. was present for a portion of the inspection. Weather <br /> conditions were clear and cool and ground conditions were dry throughout most of the site at the <br /> time of the inspection. The entire Phase I bond release area was accessible. <br /> The total permit area at the Roadside Mine encompasses 3,016 acres. The primary focus of this <br /> inspection was a Phase I bond release request of 18 reclaimed acres located within an area <br /> referred to as the South Portals. The bond release also included several small outlying areas <br /> including the A Substation, Light Use Road#1, and two small regraded areas associated with the <br /> overland conveyor tube/bridge structure that has been removed. All of these features are shown <br /> on the exhibit titled "Bond Exhibit Acres Nominated For Release" submitted with bond release <br /> application. <br /> This Phase I bond release inspection was conducted pursuant to SCC's Phase I Bond Release <br /> Application(SL-04) submitted July 10, 2008. During the inspection,participants walked through <br /> the majority of the South Portals area subject to the bond release request, to allow for visual <br /> assessment of compliance with pertinent requirements, including backfilling and grading, site <br /> stability,blending of regraded land to undisturbed areas, and drainage control. The inspection <br /> began at the northern end of the bond release request area and proceeded to the south and ended <br /> at A Substation. Several features have been approved as permanent structures at the South Portal <br /> area and are described below in the following sections of this report. <br /> Roads <br /> One access road is located in the bond release request area and is shown in the permit application <br /> package(PAP) on Exhibit 6C, Roadside South Portal Post Mining Topography. Access Road <br /> #IA was approved as a permanent road with PR-3 and is discussed on page 13-3 of Tab 13 in the <br /> PAP. A cross-section is provided on Exhibit 26. The surface of the road is gravel and the width <br /> is 20 feet. The road is well constructed and found to be in good condition(see attached <br /> Photograph No. 1). <br /> One light use road(Light Use Road#1)was included in the bond release area. This road has <br /> been fully reclaimed. The reclaimed portion of which is shown on Exhibit 6C located on either <br /> side of the RSRDA Borrow Area. The road surface was covered with topsoil and the road <br /> surface reseeded. The road was reclaimed to conform to adjacent terrain and blend with the <br />
