during this inspection. The problems should be corrected by the dates given, or they will become possible
violations. The possible violations should be corrected by the dates given to reduce their severity when
considered by the Mined Land Reclamation Board. The inspector noted on the previous page should be
notified of all corrective actions taken.

Problem/ Possible Violation: November
The proper mine entrance sign was not in place and all the permit boundary markers did 3 0th, 2008
not appear to be in place. This is a problem at this time for failure to maintain the proper
mine entrance sign and boundary markers around the affected area and pursuant to Rule
3.1.12 (1-2).

Corrective Action:
At the entrance of the mine site, post a sign, which shall be clearly visible from the access
road, with the following: the name of the operator, a statement that a reclamation permit
for the operation has been issued by the Colorado Mined Land Reclamation Board; and the
permit number. Also, place boundary markers of sufficient number and size around the
current approved permit boundary. Please submit photographic evidence to the Division
that this has been accomplished by November 14th, 2008.

Problem/ Possible Violation: December
A new access road appears to have been constructed into the mine site, this road is outside 3 0th, 2008
of the current permit boundary. Also about .23 acres of disturbed land appears to be
outside of the eastern permit boundary. This is a possible violation at this time for failure
to protect areas outside of the affected land from slides or damages occurring during the
mining operation and reclamation. Pursuant to C.R.S. 34-32.5-116(4) (i)

Corrective Action:
The operator will need to submit an amendment application to change the current
approved permit to include the area of the new access road and to encompass all the
disturbed area that is outside of the current approved permit boundary.
