III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Janet Binns of Colorado Division of Reclamation, Mining <br /> and Safety. Mr. Brian Watterson of Twentymile Coal Company accompanied the inspection. The mine <br /> is an active underground mine. The weather was cool and clear, and the mine site was dry, with <br /> occasional puddles due to weekend precipitation. <br /> Roads: Roads throughout the mine were dry and well graded. Ditches through out the facilities area <br /> have been regraded and haulroad SAE's cleaned of sediment. Several ditches, ditch E-2, and ditch west <br /> of Zero-entry shaft, need additional clean out. <br /> The hydraulic oil spill on the 6MN pad near the pump house is mostly cleaned up. The berm downslope <br /> of the hydraulic oil spill remains intact. TCC continues to clean the leak from the compressor building. <br /> TCC has received approval to dispose of contaminated soil material at the landfill outside of Milner. <br /> (The Division has not seen documentation on this approval.) TCC is in the process of dismantling this <br /> temporary compressor house, decommissioning the leaking compressor and replacing the equipment. <br /> Hydraulic oil does not reach the 6MN pond, though TCC continues to place absorbent napkins and <br /> booms in the inlet of the 6MN pond. 6MN pond is almost dry. <br /> Support Facilities: Stoker loading area expansion has not yet been implemented. Due to water level <br /> build up in the underground workings in late August, TCC has constructed a temporary"underflow <br /> storage"area in the previously approved location of low quality coal storage pile. This has allowed TCC <br /> to place coal fine "slurry" in this location while pumping water levels in the gob to acceptable levels. <br /> Most of the water in this Underflow storage area has been siphoned off and slurry fines remain. TCC <br /> will continue to allow this material to dry and then will place this material in an appropriate location. <br /> Grading of the south side of the "Big"wash plant is still needed. Ditch D-3-B still needs additional <br /> grading and shaping to keep flow from ponding on the south side of the Big wash plant. TCC has <br /> installed a culvert at the east side of ditch D-3-B. <br /> Hydrologic Balance: <br /> TCC received a temporary General discharge permit from the Colorado Department of Public Health& <br /> Environment(CPDH&E) to allow mine water discharge from 10 RT borehole, directly to Foidel Creek <br /> without treatment. This permit is effective 8/30/2008 to 9/l/2009. TCC is currently pumping from <br /> 1 ORT to Foidel Creek via a 12"HDP. The discharge point at Foidel Creek is approximately where <br /> Foidel Creek flows under Routt County road No. 33. The water flows through a culvert(20"to 24") <br /> under the Rail Road. Then the discharge flows to a grassed slough where visually iron is dropped out. <br /> Fish Creek Vent Shaft(FCVS) is being pumped overland to Pit 1. Pit 1 elevation has approximately 7 to <br /> 8 feet freeboard prior to flowing to Pond D. Pond D was discharging at a trickle during this inspection. <br /> TCC continues to manage mine water via pumping from TORT and FCVS, and either directly to Foidel <br /> Creek or to Pit 1. TCC reported that freeboard available underground was 4.68 feet in the SWD <br /> workings and 8.02 feet in the EMD. <br /> 3 of 5 WHITE-File YELLOW-Operator PINK-Specialist <br />
